Ripoff obtained judgement on account after making payment arrangements

My husband was contacted by Asset Acceptance to pay for an account that was delinquint with a phone company. He made payment arrangements with them to pay $100 a month which was to be deducted directly from our checking account. Shortly after the payments had started, they called him again in regard to an account he had with Providian. I thought we had paid that account off, but he did not dispute the balance (though we should have). He agreed to start making payments on that account once the previous account balance was paid off.

Ever since then we have had up to four calls a day both at home and his job asking when we were going to pay that bill off. Every time he has explained that he already spoke with someone and made arrangements. He has told them repeatedly that once the first debt is paid, they are going to start deducting the money from the second debt but they continue to call.

Recently he was informed that they have obtained a judgement against him for the second account. We never got any notice that they were going to court with this account and had no opportunity to explain to any judge that we had already made arrangements for this bill to be paid. There were only two more payments coming out for the first bill (now one) before they were to start the second one yet they went ahead and got a judgement anyway... Without us having any chance of giving our side.

We have contacted an attorney to see if they can stop any garnishments. If they garnish his wages the amount may be for much more than the amount he agreed to pay. We barely scrape by now but are trying to clean up our credit. The fact that we were not served any summons to appear in court and that they accepted a verbal agreement for arrangements and turned around and went back on that in addition to the amount of harassment we have received from this company is rediculous.

I am hoping that not only will the attorney be able to stop any garnishment but will advise we may have a case for harassment against them.in addition to documenting the dates and times of the calls, I hope he can get their phone records to see just how many times a day they call our home/jobs.

They are notorious for leaving deceptive messages and not saying who they are in order to get you to call them so they can harass you more. I was under the impression that once an agreement was made and has not been broken by the person that the creditor had no right to continue to call. I shall find out soon and will report back. What these people are doing is just horrible.
