In December Joan Nygaard, owner of My Vintage Sole, had purchased boots from me (website business formerly known as Lorians) at $184.00. We subsequently began sale negotiations as she wanted to buy the business. I told her in January I would refund her the $184.00 so that she could order them wholesale after owning the business.
In February of Joan Nygaard purchased my web business. The price was $8,000, of which she paid $6,000, promising the remainder. We both apparently forgot the $184.00 for her boots. After the business sale, the relationship soured.
In March, Nygaard filed an FBI complaint accusing me of fraud regarding the $184.00. She made no attempt to contact me, despite having my phone number, and knowing I was offline. My local police contacted me, and I explained the situation, and immediately sent her a check, which she cashed, for the $184.00.
During this time, Nygaard also filed for a chargeback with PayPal and her credit card company in this amount, but did not tell me (or the authorities). PayPal awarded her the $184.00, added a $10.00 fee, and charged me another $194.00 although she had been paid. I have a copy of an email she sent to one of my former customers explaining how she planned on getting paid twice, and encouraging them to do the same.
After I was back online, this came to my attention thru PayPal in early April, and I emailed her a copy of the PayPal chargeback record, asking her to remedy this as she had now been paid twice. She first claimed she had never filed a chargeback with PayPal, but when emailed a copy of the PayPal page, she said she would remedy it with her credit card company.
As of this date, July 14, she still has not reimbursed me, and Paypal is still trying to collect this from me.
I also emailed her recently regarding the $2,000 balance promised. She emailed asking where to send it, and I sent her a mailing address. I have subsequently emailed her three more times, with no further response.
This woman owes me a total of $2,194.00, has harrassed and attempted to cause me much trouble, filed and encouraged former customers who needed a refund (and whom she controlled my contact with, knowing I had lost their data, and not allowing my contact info on the new site) to file fraudulent FBI complaints, and I would like my money. She was sent a formal Cease and Desist request on April 25 to cease harrassment, to which she never responded.
My local police suggested I file a lawsuit against her, following her fraudulent FBI complaint, and told me they had requested her to cease emailing them, as they felt she was "unnecessarily escalating problems" between me and my former customers.
I have today also filed an online complaint with the FBI Internet Fraud Bureau.
