To Whom It May Concern:
Capital ones insurance partner is not liscensed in the state of Texas wher I filed a complaint against Consumer Member services, Inc of 2700 W. Plano, Texas 75075-8200 even though every letter had this physical address that I kept.

Illegal fees have been applied during 3 different insurance claims June April and November that has never been corrected by Capital One Financial Specialist and I was informed never to contact this senior anaylyst of Bureau of Financial Institututions of Virginia again pertaining to Capital One because It is stated in my letter I made false allegations against Capital One and I over-faxed my quota to their office " I have the letter dated May 23", Virginia Attorney General filed suit against Capital One May 9.

My account according to Capital One Angel Flippen justifies a $377.00 reimbursement on 3 different disability claims. My entire account needed correcting beginning in 06/05 until the end of February when Capital one was paid off, a debt collected that far exceeded what was owed on this account.

This account has underlying corrections that need to be adjusted on 3 insurance claims alone, of additional unreimbursed fees including additional increased interest and increased periodic daily interest rates that was charged to my account during these claims etc.
Capital One defaulted up to 6 months in 2002 and paid partial minimum monthly payments and defaulted monthly payments and Capital One did not apply during a insurance claim a full monthly minimum payment.

These corrections need to be made in order to correct my entire account balance for a 3-year period beginning with my 1st insurance claim that is never mentioned in any letters of Financial Specialist Miss Angel Flippens.
Capital One did not apply $1190.05 payment for my permanent disability, I the insured and cardholder paid this account off as shown on my statement paid in full December 22.

Angel Flippen Capital one financial specialist states in her May 12 letter of description of actions shows this amount paid towards my account, mailed to my home on May 12.

Capital One insurance partner Consumer Member Services, Inc never at anytime paid during all 3 claims an amount of $2,480.31 as stated in Miss Flippens letter, I the insured cardholder had to pay off this balance of $1154.90. (See statement Dec 09-January 08).
I paid insurance my premiums monthly and paid Capital One account balance.

Capital one continually charged fees that were to be waived and were never corrected that has affected the entire account beginning with a my 1st unemployment claim in 2001 and then in 2002 a auto accident disability claim, then in 2003 the accident caused a permanent disability.

My account has never been corrected during this 3 year account. This account needed correcting from the beginning of the 2001 claim that has carried an additional balance interest and fees that carried throughout my 3-year term with Capital one to the ending claim of that I the insured had to pay off.

Capoital one added fees were during each and every claim that were never waived in accordance to Capital Ones Addendum and minimum payments were never paid in full These errors have affected my total account that started at the beginning of my 1st claim.

However Capital One wants to reimburse a couple fees that they found as an error, not considering how this has affected the entire account that Capital One refuses to correct.

Capital One needs to correct the entire account and make sure since they are partners with Consumer Member Services Inc, their insurance company partner as stated in Angel Flippens letter. Capital One has control on payments being paid during a claim if they are partners withthe insurance company on time and when an insurance claim is filed, not 5 months later that added increased monthly and periodic daily interest because Capital Ones insurer never made full minimum payments during any claim.

1. Capital One delayed in approving my claim on June 05and defaulted in payments for 2 months Capital One made only partial minimum payments of a total of $102.21, for an 8 months period and refused to make full minimum payments that far exceeded $102.00.

I was charged during this claim alone from June 08 through March 08 a total of $350.00 in overlimit and late fees and was also charged payment protection insurance premiums fees of $40.69 a total of $390.69 in fees not including interest charges on this claim.
Capital One reimbursed $100.00 to this claim to my account on March 08.

This leaves a remaining balance owed on this claim only, to the cardholder of overlimit and late fees and insurance premiums that were not waived or reimbursed in accordance with Capital One Addendum.

2. Capital One delayed in approving my 2nd claim filed on April 28 through April 28 and defaulted in making payments for 5 months, my first payment was applied by Capital One on October 08 in the amount $221.33.

Capital One made only partial minimum payments for 1 year on this claim $370.41 was paid, someone refused to make full minimum payments that far exceed this amount.
I was charged from April 23 through April 23 a total of $464.00 in overlimit and late fees and was charged payment protection insurance premiums fees of $67.84 a total of $531.84.

Capital One reimbursed to my account fees that were charged in the amount of $116.00 on December 08.
Capital One issued a partial reimbursement check for the permanent disability in the amount of $377.00 April 14, for fees only charged during this 2002 claim.

This leaves a remaining balance owed to the cardholder on this claim also and late fees and insurance premiums that were not waived in accordance with Capital One Addendum.

3. Capital One delayed in approving my 3rd claim for 8 months on my permanent disability claim that was approved on June 07 that was filed on November 17 and Capital One defaulted in paying off my balance owed (see enclosures).

Capital One paid $43.97 one partial minimum payments during my permanent disabilty and refused to make the full minimum payment of $1154.90 balance owed.
I the cardholder and insured with Capital One payment protection insurance with a permanent disability had to pay off Capital One's owed balance in the amount of $1190.05 due to continuous harassment of 6 automatic phone calls made to my home per day.
Capital one reimbursed on February 08 $87.00 for fees.

Capital One issued a partial reimbursement check for my permanent disability on June 07 in the amount $365.03 of the $1190.05 that I paid in full because Capital One refused to pay this balance or waive overlimit and late fees and payment protection insurance fees.

I did not incur these above fees during these valid claims; Capital One has incurred these fees as well as increasing my balance with additional interest and fees and never making full minimum payments during a valid claim on my account for a three years period 2003 that has not been corrected.

I the insured cardholder on this claim paid the $1190.05 of a paid in full balance. This leaves a remaining balance owed to the cardholder on this claim only in the amount for fees alone in the amount of $854.20 of overlimit and late fees interest periodic daily interest and insurance premiums that were not waived in accordance with Capital One Addendum nor reimbursed, as I stated Capital One created this by not making full minimum payments during 3 different valid claims and not correcting this account 3 years ago.

This activity is not in accordance with Capital One Addendum or Disclosure.

Yes I am more than aware of Capital Ones fees, however this subject issue is of applied fees increased interest increased periodic daily interest and increased payment protection premiums during valid unemployment and disability insurance claims. Full minimum payments were never paid during 3 different periods of a unemployment claim and a disability claim and a permanent disability claim.

Capital One is the cause of my balance increasing intentionally, knowingly and willfully, with fees that increased from $25.00 to $29.00 not in accordance with Capital One Disclosure statement, etc.

Before a claim you are responsible for past due and overlimit fees incurred on your account before the date of loss.

(ll) As a result of loss, If you are eligible for benefit payments and file valid notice of claim, Capital One will access you account status as of the date of loss and going forward to the date you become eligible, if the amount of the benefit would had prevented your account from being charged past due or overlimit fees in that period of time Payment protection will pay those fees on your behalf. After loss: You are responsible for overlimit fees

Please note that Capital One misleads their customers with their insurance because it states Payment Protection will pay up to $10,000.00 or whichever is less on your eligible balance it does not state in the addendum $10,000.00or less on my credit limit because with my K-Mart Line of Credit is $400 and non K-mart is $300.00 and cash advance is limit is $300.00.

Capital One claims they will not pay more than my credit limit that I charged during my period of being a cardholder which was $300.00. Where did the remaining $835.00 dollars go that I was not reimbursed when I paid off the balance of $1190.05 and if my credit limit was all that was to be paid why did they accept over a $300.00 payment?

Capital One never AT ANYTIME MADE ONE FULL MINIMUM PAYMENT during a valid claim and in accordance with Capital Ones Addendum payment protection.

With all of the above being statistically and accurately corrected by Capital One from my 1st, 2nd, 3rd insurance claim and all minimum payments paid in full instead of partial payments, all fees waived and removed as well as the interest being and the periodic daily rate corrected and insurance premiums being corrected I would receive a reimbursement that far exceeds $377.00 because Capital One collected far more than what was owed on this account.

Capital One personally needs to correct my account of the inaccurate balance and remove according to your addendum all payment protection insurance fees and membership fees late fees and overlimit fees increased interest periodic daily interest that has continually being charged to my account during valid insurance claims of 2003 and carried over to my account when the claim ended, as well as carried over onto my account at the beginning of a new claim during the claim and ending of a claim.
