My mortgage was purchased by Fairbanks in February. I was not sent any correspondence from them until late March. They would not accept payments from me because their computer records had not transferred all of my account information from my previous mortgage company.
This went on for six months. Every month I attempted to pay the mortgage and every month they would not accept it. I finally spoke to someone who told me that because of the dates of my automatic bank debit with my previous lender, it was locking the computer up because of a little over $100. They would not accept this difference either. Finally in August I mailed this exact amount. They held the check for one month before depositing.
I took this as a sign that the computer records were now clear. I began mailing in 2-3 mortgage payments at a time. They returned the checks to me with a letter that they could not accept anything other than the full amount.
I attempted to make a payment arrangement or refinance since it was their computer error that had caused this problem. Because I did not have a permanant full-time position, they refused to enter into any arrangement.
Since that time, they have sent foreclosure notices 4 times. They have continued to add late fees every month for two years as well as several hundred dollars every time they threaten foreclosure.
When I landed a permanent full time position in November I immediately called them to set up a repayment plan since they claimed this was the only thing standing in the way. Their new excuse was that I didn't make enough money. I offered and could afford to pay 1-1/2 payments a month. They declined.
I have worked with the FTC and VA Attorney General's office. They tell me that it is wrong and they can't do this, but that there is nothing that they can do to help me. I have not found any attorney willing to fight Fairbanks and now am forced to declare bankruptcy to put an end to this.
This month is the two year anniversary of when I was cursed with Fairbanks. I can't wait to get the bankruptcy over with so I can refinance and get a new mortgage company!
