Fairbanks acquired our loan in 2002.in 2003 I lost my job, my husband and I maintained our regular mortgage payments until August. We called Fairbanks to let them know that I was out of work and we would like to work out a payment plan. They said no problem. We sent them all of our financial information.
In the meantime we were unable to make full payments, we sent what we could, but they returned it saying they couldn't except it. During this time we corresponded with them through certified letters we sent, asking them to call us and respond to our letters. No one ever responded.
We had a lawyer call them and they admitted that their computer systems did not link to one another and payments we showing delayed. They finally sent us a letter of potential workout plan. Again we sent all our information. We kept trying to send money, they did not want it. So my husband and I put the money in the bank, because we knew they would need it to enter into a payment arrangement.
Then I lost my job again in called Fairbanks immediately to no avail they said they would need to get to us. We acquired a company to negotiate a repayment of arrearages. We stated that we would like to keep our home and would find the money somehow.
I was lucky to finally receive a job where I doubled my income. At this point Fairbanks says we owe them a year's worth the mortgage even though we have prove of payment up till August. And we also have the checks that they sent us back.
The company we hired to negotiate, couldn't believe that they sent us a letter stating that they are foreclosing on our property, due to the fact that we have been in negoitations with the bank for 3 months now.
Is there any lawyer or person out there that can put a stop to this? Please help all of us vicitms. God bless anyone who may be able to help all us who have been subjected to this cruelty. Remember to pray, God is on our side. God Bless anyone with a mortgage at Fairbanks.
