My trouble began in 2009 with HSBC mortage. My husband lost his job and a week later I lost my job. We contact HSBC to work out a loan mod were told to send in a certain amount of money and then out new payment would be $703.00 a month. So we sent in 4 months payments with the severance we received when we lost our jobs. A month after our checks were cleared we were contacted by HSBC and told that our loan mod was approved for a different amount than we previously were told. When we sent our payment in it was sent back with a cancelled check and a statement telling us HSBC can not take our payments unless it is the full amount. Then we were told that we are behind in our payments. This went on for months.in 2010 we were served with forclosure papers. After speaking with our attorney we found out that HSBC doesn't have the title to our property. When the mortage was sold to them the title was never transfered. Now here it is 2011 and no one knows where the title is or who has ownership of it. When I look on the county assesors page it still has the old mortage company's name on the deed.
So needless to say we have been in the house for 12 years now and haven't made a payment for over 3 years. This is good for us, but if we ever decide to sell the house we can't.
