Renter beware of unfair billing practices

Action Property Management in Gilbert, Arizona has shown my family that they lack morals and integrity in regards to their billing practices.

Here is our story regarding Action Property Management in Gilbert, Arizona.

In July of my family signed a rental agreement for a house located in Queen Creek, Arizona. As soon as we moved in to the house, the toilet downstairs overflowed. Not a little, but flooded the living room. We immediately called Action Property believing this was an emergency. Several days later we received a call back from them!

Action has proven their billing practices are unethical. On November 1st, we dropped our rent off at their office located at Cooper and Elliot. We dropped our rent off almost every month instead of mailing it, to ensure the rent was received ON TIME. On November 3rd, my family left for a vacation in Florida and a cruise to the Bahamas. Action Property claims we dropped the rent off on November 7th, and charged late fees at $5.00 a day for seven days! We were not even in the country on the day they stated we dropped the rent off!

Action Property has made a habit of holding our rent check until the 6th, and then charging late fees. They have done this on many occassions. And when we have emailed them, we have gotten no response. When we have called, we can't speak to anyone in their accounting department. We leave messages. And when we have gone down in person, the front desk lady wants to argue with us!

And finally, on two occassions the HOA had sent a fine to Action saying we were in violation of the CC&R's. On both occassions, it was our neighbor who was in violation. The first time was trash sitting next to his gate and the second time was his car parked in front of our rental house. On both occassions, the HOA removed the fines. However, Action Property refused!

The third HOA violation was over the coach lights next the garage in front of the house. These lights never worked since moving in. The HOA requested the lights be repaired so we faxed Action Property a request. After a week of no answer, we called. We were told the HOA was responsible for repairing the lights! Knowing this not be true, but being dilligent, we contacted the HOA. They laughed, and said the Property Management Company needed to repair the lights. Two months later, and two HOA fines later, the lights were repaired.

At the end of February, my wife and I appeared in Justice Court in Apache Junction to face a forcible detainer lawsuit. Action was suing us to evict us for non payment of rent!!! The rent has been paid, late by my own admission twice, not the many times they state.

My wife and I thought FINALLY someone would listen to our situation and justice would be served. If you have never gone through an eviction, if you are the tenant, tuck your tail between your legs, because the law is not in your favor!

We lost the case. The judge said I did a job representing myself. I laughed and said if I did, I would have won!

As we walked past other people waiting for their time in front of the judge, many asked us what happened.in shock, we didn't have an answer!

I provided the judge my paycheck stubs, showing I had the funds available to pay the rent on the dates written on the checks. I showed the judge a letter from the HOA stating we have been in good standing and still are in good standing! I provided the judge a breakdown of Action Properties billing, showing where their mistakes, or blatant failure to give an accurate accounting is.

And I still lost!

The last "action" Action Property took was to cash the last rent check they stated they did not accept! Per the Arizona law, they should not have cashed that check!

As it stands now, I have a motion before the Apache Junction court to be heard next Tuesday. The motion is to have the judge throw the judgment out, due to the fact the plaintiff has cashed a check they were not suppose to.

I am also in communication with an attorney who may represent us at the trial once we get to appeal this whole mess. I am not sure if I can afford the attorney or not, that is still being decided.

The bottom line is this. Action Property Management, located in Gilbert, Arizona, has proven beyond a shadow of a doubt that they are willing to go to any length to squeeze money from the people who rent from them.

I wonder how many other renters from Action Property have experienced the same misfortune.

One interesting part of this story, as I speak with people in regards to our problem, they cringe when I say Action Property Management, even cringe when I say who their attorney is, Guy Wolfe!

I knew I was in for it when the plumber finally showed up when we first moved in. THEIR PLUMBER said he doesn't hear too many good things about Action Property.

I guess the plumber wasn't full of it!
