Anyone interested in starting Class Action Law suit against America's Home Place?
Construction started March '07 still not in home. Shoddy workmanship, roof leaking, molds growing, more problems than I can mention. Company wants to say work is done. Asked for arbitration, my lawyer did not get information on who we could call as witness untill 2 days before meeting. To late to serve. Arbitrator arrived with America's Home Place team of lawyers. Went through complaints of bowed walls, roof leaks, rain blowing in under doors and windows, Safety concerns of improperly installed fireplace, flamable materials with in inch of firebox, stair railings loose and wobbly etc. Their " Mold Expert " did not take samples or enter home untill day of meeting, said expert who examined house and had samples of mold lab verified by outside lab, was wrong, " he could not smell mold so there was none"
Arbitrator sided with America's Home Place saying they should be given opportunity to fix the same problems we had been bringing to their attention for over 6 months. The regional manager who had been to the house numerous times and claimed to be an expert on construction and codes did not notice that archways he had personally insisted were perfect finally admitted that even though he had worked to correct arches for months that they were totally wrong. Was told that roof leaks on new home were to be expected.
Could not call the fired manager or the two fired project superintendants to refute any of America's Home Place's statements. Seems America's Home Place did not want them to testify as to problems.
Now America's Home Place wants to C.O. The house and get paid and maybe come back under waranty to fix problems. Only the local reputation is no warranty work ever gets done for anyone. They have a local history of putting off any return for warranty work untill warranty has expired.
Local Building and Zoning came out this week saw rain coming under doors and windows, multiple roof leaks, structural problems and said no way was home ready to C.O.
Need lawyer willing to take on america's home place in class action lawsuit, for substandrad work and failure to deliver the quality custom home as advertised inprint, billboards, videos and tv spots.
