Botched Delivery Damages Home

On May 2, two men from 3P Delivery damaged my kitchen floor while attempting to deliver a chest freezer purchased from hhgregg. Their insurance agency, NTA Inc., has refused to pay for the repair or replacement of the floor, and has denied the claim completely.

The delivery charge was $69.99. Although it was called DS1-Deluxe Delivery, it was the only delivery service offered by hhgregg. At the time, no one told me the delivery would be outsourced. But when I had damage to report, I was told that hhgregg could not do anything for me because the damage was caused by this outside delivery service.

Today, while gathering information for this complaint, I learned that the phone numbers I had been calling to reach 3P Delivery are listed under hhgregg on Memphis Ave in Cleveland. Here is the toll free number: 1-866-367-8080, which also traces back to hhgregg, even though they told me it was 3P Delivery, a separate company.

From the start there was something wrong. The lead delivery man complained about being in a big hurry, and brushed off my concerns about the lack of safety equipment, such as blankets and straps. The two men carried the freezer in the front door in bare hands, and set it down on my kitchen floor to discuss how to get it through the doorway to the basement where it was supposed to be installed.

The lead delivery man said he would not complete the delivery unless I signed off on liability. He was a big man and he intimidated me. I had already paid for the freezer, and he was saying he would take it away. Although I signed a statement, it was under duress.

Next, the two men pivoted the freezer on one of its four corners, twisting it before lifting, and this tore a gash in my vinyl kitchen floor.

Soon they discovered the freezer would not fit through the 2nd doorway, and returned it to the truck, leaving me with a damaged floor and no freezer.

When I called for help, one of the delivery company's managers told me that they would take care of my damaged floor, even though I had signed the statement. I believe 3P Delivery and hhgregg should honor the word of their manager, and make good on this.

It seems as though hhgregg may be claiming to have outsourced the delivery in order to avoid responsibility.

I believe hhgregg is responsible, regardless of whether the delivery company is a part of hhgregg or not, because my sales contract was with hhgregg.
