March 30 I purchased furniture costing $4278.59 from Upscale Furniture Outlet. Tony Poole, salesperson said 50% of the cost had to be paid before placing the order. I requested delivery in 4 weeks. May 3, I returned to the store to pay the balance and to schedule a day when the furniture would be delivered to my home. Tony said the furniture had not come in and that it would be another week or two.

Just before the Memorial Day holiday I telephoned Upscale Customer Pickup/Delivery and was told that my furniture order still had not come in. I schedule a future delivery date for June 29, believing that the furniture would be in by then.

As required by Upscale, I telephoned two weeks (June 14) before the scheduled delivery date to confirm delivery on Saturday, June 29. And I was told by a lady in the office that my furniture would be delivered on June 29. The day of delivery came and went and still no furniture. I spoke a lady in the Upscale office that evening who said that the furniture had not arrived. Therefore no delivery was scheduled. I request that the Manager call me on Monday. George from Upscale called on Monday, July 1 and apologized for the inconvenience and promise delivery of the furniture soon and offered a gift certificate. The month of July came to an end and still no furniture or gift certificate. August 12 I telephoned Upscale and some the furniture had arrived but was not scheduled for delivery because they were waiting for the other pieces to arrive.

August 13 I went into store and was told by Mimi Williams and received in writing that the furniture would be delivered to my house on August 24. And because of the delay I received a silk flower arrangement and three candle holders with candles. Spoke with Mimi on August 23, to confirm delivery on Saturday, August 24 and was told not all of the furniture had arrived. I requested a full refund. My refund request was denied. Moreover, Mimi said all sales are final and no refunds.

I informed Mimi that I have in writing that the furniture was to be delivered on August 24. Mimi said she did not say all the furniture would be delivery and that she scheduled a partial delivery. At that point said to Mimi that she playing games with me and the letter read Mr. Lathem and myself (Mimi) have scheduled your delivery for Saturday, August 24.

Upscale management has never taken the initiative contact me on their own. I have had to always initiate the communications. Upscale management refuses give me a refund and insist that they are not responsible for the delays caused by the manufactures or distributors scheduling or delivery, availability..
