In February, my husband and I decided to get a hot tub for our disabled son, who would benefit from the hydro-therapy. We went to Master Spas-Island Leisure of L.I. We explained that we needed to get permission from Family Court to withdraw the money from our son's account. We were told no problem, when we're ready, they'd be ready.
In April, after receiving the check from the bank, I went straight to Master Spas-Island Leisure of L.I. I explained that I had the check, but still had to wait for the deck to be installed. I was told no problem, come back when the deck is done.
In May, my husband and the contractor, went to the store to verify measurements (the tub was being installed into the deck) and to order the tub. The contractor said he'd be ready for the tub in 4 days. The salesman said no problem, we'd have the tub and took the check that paid for the tub in full.
Thereafter, followed a series of delivery dates that we didn't get the tub, weekly visits to the store, excuses that people were sick, did not know what was going on, what tub was ordered. Then towards mid-July, the truck was leaving California, Indiana, West Virginia. Then the truck was delayed from leaving. We were told to call the warehouse, which of course had no idea what I was talking about; they didn't have any paperwork for our delivery.
During all this run around, we filed court papers to get the tub or our money back. The earliest date we could get is 9/28/05. My husband told the clerk he was afraid this business would go out of business, what were our chances of getting our money back. We were told by the clerk, better hope that doesn't happen.
Then on August 3, we got a call from the owner, Rick, who said the tub was in the warehouse. The tub would be delivered on Saturday or Sunday (8/7 or 8/8). We were on vacation but we gave him our cell numbers (again) and my husband's parents were home to receive the tub. No return phone calls from Rick.
On August 11, my husband got a call from Rick who said the warehouse refused to deliver the tub because of the pending lawsuit and what were our plans. My husband said as soon as the tub is in our deck and working properly, we'd drop the lawsuit. Rick said good, he'd call the warehouse to tell them to deliver the tub. Rick would call my husband on Monday, 8/15, with the delivery date and time.
We are still waiting from Rick's call! My husband went there Sunday 8/22 and found the closed sign and everything gone. We had also left e-mails with the Better Business Bureau and CBS Shame on You. The BBB has written us and then yesterday my husband spoke to someone there who gave him the name and number of the D.A. He spoke to the D.A.'s office yesterday and now their investigating.
If anyone else has any more ideas, we'd be glad to hear them. Also, we thought it was a Master Spa that had been ordered and we were corresponding with Jared Ball from Master Spa. Mostly, they've been investigating the situation, but they can't do anything because it's an independent dealership. Then our deck contractor showed us the pamphlet which has our tub in it. It's a Malibu Spa.
Well, I contacted Malibu Spa. The man who answered said he was familiar with Island Leisure, and they are going to make good on everything, but I have to contact them. I told him that their out of business, floor models gone, phone is disconnected and he said I know they've moved. I asked if he had the order for my tub to be delivered to Bohemia, NY and he immediately said no. There are no scheduled deliveries. He's just the retailer who repairs and resells tubs!
Someone please help us.
