The first part of Jan. 2005. Our kitchen drain plugged up after spending a week trying to unplug it. We phone the LaGrande, Oregon Roto-Rooter they sent a man over to the house the next day and he ran a power snake down the drain. He then informed us that he could not unplug it because he said the pipe underground has collapsed. He then told us he could do the work of bringing in a backhoe and dig up the yard to replace the pipe. I told him since this was a rental I would have to discuss it with our landlady. We gave him a postdated check for $95.00.
We spoke to our landlady and she was very upset, She was very mad and said she had the plumbing replaced 6 months ago and she would get the original plumber back here that replaced plumbing because if it was collapsed then the warrenty would cover it. After waiting 5 days the plumber came over from the other company and he ran a power snake down the same drain and he successfully cleared the clog out of the drain. He inspected the pipes and they were in perfect condition. The problem was grease in the drain.
I phone the County Sherriff because they will arrest you here for a bad check even for a few dollars and I wanted to get advice. I was told we could stop payment on the check because when we hired Roto-Rooter to clear the drain and they didn't then the law considered them in breach of contract. So we put a stop payment on the check. Yesterday the plumber came by mad and wanted the money and I told him he didn't do the job we hired him to do and therefore he was not going to get paid. He told us That he was going to sue us I said "go ahead because I will bring in the other plumber" I told him that my landlady had to hire another plumber to do what they didn't do.
My husband phoned the LaGrande, Oregon Roto-Rooter and asked to speak to the manager and when the manager came to the phone and I overheard the conversation and the manager asked him if he was the guy who stopped payment on the check and my husband said yes and the manager said that he wasn't too happy with us and my husband said "well we are not too happy with you and he got mad and told my husband to F off. My husband said well then there is nothing more to say. I called corporate and lodged a complaint and then I plan on filing a complaint with our state attorney generals office. They can sue us if they want because I will bring in the wittness's including the other plumber to testify. They did not do the job they were hired to do and I will not pay for that kind of service. That manager has no business dealing with the public with his mouth and his attitude. I hate the think of the money that would have been paid out if we had allowed them to dig up yard and replace pipes when they didn't need to be
