Theft deceptive trade ripoff

"AS IS" WARRENTY ABUSE / FRAUD FROM A USED CAR DEALER
I bought a used 1994 Ford Explorer Auto 2000 outlet located at 15328 FM 1825 pflugerville, Tx. 78660 on 05/29. Within this first month I had returned this vehicle over 4 times to the dealer for several serious problems brakes pulling to the passenger side and grinding, transmission not engaging or slipping when I drove down the road and fuel lines leaking on the engine block.

The first time I had to take it back I was told that it was fixed they changed the brake calipers that would be ok now when asked about my fuel lines he said I would need to bring it back another time to leave for the day. I arranged a time that week to leave it over night and was told then that they fixed it when asking for a copy of the work order he said we don't give them out. This time after looking at the work I told them they had put the wrong type of hoses not the kind for a fuel line and they needed to re-fix it that the lines still kept blowing off causing serious driving dangers in traffic (didn't move) This is the lines that go to my brakes, fuel and transmission.

I received the truck back at this time with new hoses and no clamps to keep them in place. My brakes and transmission continued to not work right the brakes continued to grind and pull and the transmission still slipped or did not engage. I requested my money back so that I could purchase a vehicle else ware since it was obvious they could not fix this vehicle.

On 07/21/04 Charlie the sales agent I had been working with all along agreed that this was not something that could be fixed and offered me opportunity to trade for another vehicle on the lot for equal value telling me that was my only option since he could not refund me my $500.00 deposit. The only thing that even would start at the time was a car 1992 Mitsubishi. (Far from a utility vehicle that I had wanted for family reasons) I was told do not worry about the mileage it had a new motor and transmission just put in so it was a "good deal" I test drove it for as much as you can had my son look at it seemed fine until 2 hours later off the lot it broke down making a lot of noise and racket I called them immediately and let them know which they offered to have it towed back to them to do any repairs needed.

My vehicle was with them for 4 days (I had to get a rental) I was told it was fixed and it was the alternator. I have it back and not even 100 miles placed on this car and the motor blows! Bottom line I asked on both vehicle to have a copy of work being done on the vehicles and I was told "we don't do that" then after being told that this vehicle had a new motor and it blew with only 100 miles on it I highly do not think this was a new or even rebuilt motor. I am suppose to make my FIRST payment on this 2d vehicle with them on 08/11/04 but this is my situation its not that I don't want to pay it but when I called to find out what they found was wrong with the vehicle (they never called me after taking it to there shop) I was told that it was the motor blown and that as soon as I have $1500.00 they will fix it and I can have it back. WOW!

I am afraid to make a payment and try any more to resolve this issue with them due to them towing my broken car back to them and telling me I would need to pay them $1500.00 to get it back. Now since I am not behind in payments they cannot do this legally. I am out a car, my money I have full coverage insurance that I do not have a vehicle but have to continue to pay so that it is not canceled until I buy another one.

I know that used cars are "AS IS I was going to be paying a lot for my vehicle and I went to a used car dealer because of credit issues not because I wanted a car to pay on and not drive. I expected a car that would run. Lemon Laws should cover this or Fraud Laws should. This dealer sold me a car knowing that my intent was to have a vehicle that ran minor issues are reasonably understood but under the circumstance this was plain fraud the theft. I asked to speak with the owner and was told that that was impossible and she would not even speak to me. (Good business practice if you know you are ripping people off) I have reported this to the motor vehicle department and I am awaiting an investigator I have reported it to the BBB. I have lost so much work in the last 2 months (I am a loan officer I need my car) I have a baby grandson at home and I am under the impression at this point I have to take them to court.

I intend on going to court. I will not have this placed on my credit report due to there insane business practices. If all is gained I hope that others will be more aware of lack of rights in buying a used vehicle and do not get taken advantage of such as I did from this State licensed dealer taking advantage of the Texas AS IS vehicle laws to rip of customers.
Below is the expected cost of both vehicles that did not run. I know I did not check the blue book first and that I was unaware of the interst being higher when I agreed to the second I just wanted a car that ran and was frustrated, mad that I was forced into a vehicle I did not really want but needed something to drive or my money back.

My Request is this: I would like a full refund of my deposit for $500.00 down and I would like my payments made to them as these vehicles still were in there shop more than with me I was unable to drive and had to receive a rental. Cost of $ 600.00 for a total of only $ 1100.00. This is not including any lost wages! I only want what I put out so that I can leave this all behind me. If I go to court I will request court fees and loss of wages.

My cost from dealer $14,329.92 with 23.94% interest paying $300.00 a month.
92 Mitsubishi blue book $ 4625.00 in fair condition
My cost from dealer $ 13,524.48 with 24.02% interest paying $ 280.00 a month
