Helms Bros. Ripoff, theft, lied, didn't credit us

On Aug. 29th we went to Helms Brothers to buy a car we saw one we liked but is was pre-owned and there was a few scratches and the bolts on the wheels were rusty and there was a few things to be fixed on the car so the first Salesman we went to Herman promised it would all be fixed up and Show Room ready when we went to collect it. When we went back to collect the car nothing that we were promised was done to the car so we were very dissappointed and told them that we didn't want it, the way it was. Herman was gone on vacation and no one could contact him so Michael Altamura helped us.

On Aug. 29th We had left a $1,500 deposit in good faith and the car was going to ready to pick up on Aug. 31st. We went to pick up the car and none of the scratches were taken out and the bolts on the wheels were still the same and basically the car was the extactly the same nothing had been done to improve it, and it was certainly not show room ready. We explained that if we were told this in the first place that would have been the end of it., and nobody's time would have been wasted because we were not interested in the car the way it was, and we were not going to take the car.

Mike Altamura then told us fine we will do everything we promised but you can not pick up till the 6th of Sept. Because it will take a few days to fix the car the way we wanted it, and on that day Aug. 31st. We bought a extended warranty for the car that cost $3801.89 and that was also put on our credit card. So Tuesday Sept. 6th came and we got a call to say the car was not ready and would not be ready till Thursday and again on Thursday 8th we got a call to say it still was not ready, and on Friday 9th it still was not ready so on Saturday the 10th we went to another dealer and we saw a newer car with nothing wrong with it. So we went back to Helms Brothers on the 10th of Sept. To tell them we wanted our money back because they had not came through on the deal they promised us, we spoke to Mike Altamura and told him we wanted our money credited back to my credit card. He told us no one was there to do it and it would be done on Monday 12th of Sept. During the Week I called the credit card company and my account was still not credited so I called Mike Altamura again and he assured me it was done. Today is the 25th of Sept. And I called my credit card company as I always pay my balance every month to be told my account is still not credited so I have to pay that extra 5301.89 to my credit card company because they did not credit my account. Who in god's name has a extra 5301.89 to pay to a credit card theses days we are paying for a car we don't have and a warranty for a car we don't have. We went to a Mercedes dealership because we thought that they would be the best so we were expecting to treated probably these people have been very unprofessional in their dealings with us, The made us promises they didn't keep took our money and have not credited us back. I would not deal with them again and a WARNING anybody else who is thinking of using HELMS BROTHERS, BAYSIDE. Don't waste your time.! I need helms brothers, bayside to credit my account that is every consumers right if they are not happy with a product. I NEVER RECEIVED ANYTHING AND YET THE STILL HAVE NOT CREDITED ME and I have a extra 5301.89 on my credit card to pay off.
