Worst company they finance lemons then when they break down they take u to court

I was excited in Aug when I received an email saying that I had been approved for a car of my choice. I headed that same week to the dealer. When I got there the dealer was not what I had expected but I felt that with my credit history I had to take what I could. They financed their own vehicles so they assured me I would get the car. First the dealer told me that I could choose from a list of about 10 cars. All used.

I chose a 1999 Volvo... Silver, leather interior with a sunroof. I was so excited. About two weeks later the passenger window which were automatic wouldn't function. The service engine light turned on and to make matters worse it needed an oil change because it hadn't had one in over two years according to the mechanic.

Then in February the car broke down on me. It wouldn't start it wouldn't do anything. I then called the dealer but since I lived in Des Plaines and they are located in Waukegan I figured it was the battery and any mechanic or auto shop would be able to put a new battery in.

It was not the battery, after 3 auto shops and 500 bucks in storage and towing fees I was told there was nothing that could be done it was not the battery, to take it to the dealer. I called the dealer that same night and was hung up on as soon as they heard what I was calling about. I called back again and told them I wanted to speak to a manager and was hung up on again. I called one more time and pleaded with them in tears to help me. I was 6 months pregnant with kids and needed my car to get around. They hung up on me again.

My older brother called and the man that answered the phone told him that they already had spoken to me and that I had agreed to have the car towed back to their dealer and have their mechanic look at it. They told my brother to call back early in the morning to arrange for the tow truck to pick up the Volvo. I woke up early about 7 and called my brother and told him to call back the dealer and ask them what time would the tow truck be available to pick up the car. He called and they told him that they didn't know what he was talking about and hung up on him.

I was pregnant broke and without a car. I was wasting about 100 dollars or more a week on cabs to get around. Finally I called Consumer Financial Services who financed the vehicle and told them that I could no longer pay for the car to pick it up. The lady told me that she didn't want the car she wanted the money. I told her where the car was at and to pick it up. I gave her the name of the mechanic and address and number. She said she'd call me back the next day and I never received another phone call from them.

Two weeks ago I received a phone call by the so called owner of Consumer Financial Services (Jeff Brinkett) who yelled at me that his money had been good but that mine had not been. This and that. I explained that I guess it was his sister who I had spoken to when I told them to pick up the car and that she never called back and that the only reason I know they never bothered to pick up the car was because the mechanic called me about three weeks ago saying that I owed him 1200.00 dollars in storage fees. The so called owner said that he didn't care about the car he wanted the money. I told him not to ever call me at work again and that he could reach me at the number they had on file for me. He told me he was going to sue me and I told him fine. They can't sue me and take what I don't have.

Two days later while I was at work I received a call that was transferred to me by another co-worker. She said that I had a phone call and that it was a customer who needed to speak to me. I am a customer service rep so it didn't seem to be nothing out of the ordinary. It was the so called owner again. Telling me that I was going to be served with papers that same day and to avoid the embaressment of them going to my job to verify all of my information which I did. He then proceeded to tell me that I needed to pay his money and I told him not to yell at me and that what he was doing was against the law. He told me that he wasn't and that if anything he was being nice to me and I should be glad he was still willing to work with me. I told him not to ever call my job again.

The next morning he called again and once again although he could've pressed 0 and asked the operator to connect him to my line he did the same thing again. Connected to our customer service queue and asked the smae person whom had answered his previous calls to transfer her to me because he was returning my call. I had never called him. She told me before transferring him to me that she was hesitant about him because if he was returning my call he should know my extension and since I work in specials I shouldn't be having customers calling me as I only deal with sales agents.

I told her it was okay to transfer him. He then told me that the only reason he called was because he wanted to know if he reached an agreement with the car dealer to accept the car and I pay for a tow truck ($400.00) to tow the car. They'd be able to re-sell it. I told him that they knew where the car was and when I had called to pick it up they told me they didn't want it and now they did. I told him to please stop calling my job and that it was my second time telling him this already and to stop lying because I could counter sue him since he was violating the Fair Credit Acts. He said he wasn't and started yelling at me. I then just hung up.

He called me at my job after I had already told him to never call me there again, twice. He obviously knew I wasn't allowed to receive personal calls otherwise he would've never lied twice about who he was.

On Sunday two men showed up at my parents house and handed them some papers for me and left. Apparently, I was served papers while I wasn't there. They were not even in an envelope and look like bad copies. Today a lady from their office went to my parents house again and was banging on the door and asked my brother where was I. He responded that he didn't know. She then asked him where I worked at and he told her that he didn't know either. She then told my brother all she wanted was the car and my brother responded she told you guys to pick it up months ago. It's at the mechanic where it broke down. She told my brother that she had no idea that it had broken down and all didn't want any problems. She left but not before giving him her card.

What can I do? I'm thinking of filing for bankruptcy. According the papers I owe them close to $10000.00.in the Kelley Blue Book the car is about $6000.00.
