Charge me sales tax on Manual Labor in the State of Texas and did not fix my Boat

I took my boat into Stone & Sons Marine on 5/27 informing that my boat would only go 5mph on the water. The mechanic Joe stated to me that he will have to check it out and will let me know what the problem was by the next day. I agreed and stated that I will wait for his call, he called me latter on that day telling me that carburetor need to be rebuild a new carburetor base gasket and a wire needed to be repaired or replaced that was going to the fuel pump and the cost would be $477.00 for the labor $192.46 for the parts, SUB Total $669.46 TAX $55.23 Grand total $724.69.

I asked the mechanic Joe will that fix the problem. He replied (Oh yes your boat will go so fast you're going to have to hold on to your hat or it will be in the water) so I told him to go ahead and fix it and when will it be ready? He stated that it will be ready the next following day and I will have to bring cash they don't except checks or credit cards, so I came in the next day and paid their casher $724.69 in cash.

After taking it out on the test run the boat had no change in the speed. I took the boat back and told Joe the boat is doing the same thing as it was before when I brought it to them the first time, which it still goes about 5mph on the water. Joe said let me take a look at it!!! He stated (it sounds good) and I said it always sounded good but it still goes about 5mph on the water.

They hooked the diagnostic machine up to the out drive and determine that the coupler was bad, now I'm wondering why they didn't do that the first time. The test showed that the engine RPM was about 5000 RPM's and the out drive was about 1700 RPM's, when the out drive should have been about 4700 RPM's. After testing it he determining that the coupler was bad and the engine would have to come out in order to replace coupler and it would cost about $1500.00. A $1000.00 for labor and about $500.00 for the part.

I talked to the owner Jack and told him that I would give him a call later because I had to go to work. I called Jack back and informed him that I didn't think that was fare to charge me for the same problem that I brought the boat in for, so he stated to me that he would discount me the $477.00 from the labor from the first repair.

I agreed and I felt like this was fare enough scene I did have the parts on the boat although they did miss diagnose the problem. Some type of way he came up with $1058.00 tax, so I said Jack you charge me tax the first time on labor and I didn't say anything now you are going to reimburse me $477.00 of the labor and not give the tax back on the $477.00? And also charge me tax again on labor? He stated (now you are trying to nickel and dime me) I told him no I am a fair person and I just want to be fair about the situation.

I told him that there are no taxes on Manual labor in the State of Texas and you are wrong for charging people that. He stated that he has a tax ID and charge taxes for labor, I then stated to him, I will take this lost and take my business somewhere else. I think the owner Jack and the mechanic Joe are good people but they just don't understand the Texas Tax Law. Although I do want my boat fixed I would just rather have my money back.
