In May of I contracted with Downs Ford in Toms River New Jersey to purchase a Shelby gt500 KR. I bought the car from Ebay, I was told a $10,000 deposit was due, and that the car would be delivered sometime in July. July turned to October, and by that time the KR's were everywhere. I informed the dealership that I was no longer interested in proceeding with the purchase, they told me they were keeping the deposit.
The week of Christmas the dealership finally took delivery of the car. To this day they still will not refund the deposit. Ebay has a policy on presales that they must be delivered within 60 days of pre sale. The dealership sold two cars on the same date, and I have been informed that the other customer is fighting them as well to get his deposit back. The dealership finally agreed to return half of the deposit, but they will not return a dime more. If I go to small claims my max that I can get is 7500. Otherwise I will need to hire an attorney and it is going to be a long drawn out process as well as costly. If I do file the lawsuit I have considered naming Ford Motor Company in the lawsuit.
I have tried phoning Ford, but they claim that they do not get involved with their independent dealers. I know the power of the internet and I am hoping that your readers or you can help guide me what I should do, so that I can get my 10,000 dollars back in a timely manner that doesn't' cost me a ton of money. Please help me.
