Salesman Fraud

In March I leased a Lincoln for the above mentioned dealership. I was driving a leased BMW with one (1) months rent due ($550.00). The dealer paid the last month to BMW (on paper) and was to return the car to BMW.in August I received a notice from BMW that the car was returned two (2) months late and I owed $1,100.00. I contacted the salesman who told me he would pay the late fee. The late fee was never was never paid. At my last contact with the salesman in December he told me he was not paying the late fee and to take him to court. I would like the late fee paid. I'm also curious if there was some type of fraud or theft involved. Should the Police be notified?
