Winnebago Industries And Myers RV CENTER In Churchville, Ny. 14426 Purchased a new RV. Not told of defects! Churchville, New York and..., IOWA

My friend and i jointly purchased a new recreational vehicle from one Myer's RV Centers, LLC in Churchville, NEW York.
It was purchased new by myself and my friend in Dec. 2006 and we took delivery in late April. The vehicle was a 2006 Itasca 38T, which we were informed was A ' top of the line" recreational vehicle and certainly this representaction was reflected in the purchase price, which was in excess of $178,000.

Since taking delivery, we have experienced a variety of problems, which I already communicated on numerous occasions to personnel at Myer's RV Centers.in light of the number and extent of the problems experienced by myself and my friend, it appears we have been sold a defective vehicle, one that does not even come close to living up to any reasonable expectations (warranty of merchantability) in terms of quality and performance.

We have already paid nearly $8,000 to have various repairs made, and we have also lost countless hours of our own time attending to the numerous
defective conditions.

One particular area of concern involves the issue of paint / undercoating. We understood the RV was to have protective undercoating, a mask front exterior protective, and a special protective paint. Based on the fact there is considerable rust underneath the RV and its already sustaining the type of exterior damage the alleged protective / was supposed to prevent, our understanding is that these itmes were not provided.

We contacted one independent RV dealer who performed an assessment and repair on our RV. HE noted some of the problems: He made it clear that the RV was not properly prepared for delivery by the retailer and that no proper pre delivery inspection could have possibly been done.

We feel we have a case for claim under New York's Lemon Law..?? We should have been told of the problems with our RV Before we purchased it.

We are not willingly to simply ignore thr very obvious defects. Or breach of warranty of breach of contract issues. The vehicle we recieved was not the vehicle we recieved and our damages continue to mount as a result.

We may have to commence with a lawsuit! BREACH OF CONTRACT, breach of warranty of merchantability, negligence and Fraud.
