Outrageous and surreal purchase experience ripoff

We are aware of our debt to income ratio and pursued the purchase of a new truck without expectation of success. We agreed upon a sales price, down payment, interest rate, payment duration and trade in value for our other Dodge truck. We paid the down payment via credit card and my partner signed the familiar stack of papers of a promissary note, purchase contract, odometer verification, sales tax, extended warranty and extended service contract, etc.

I witnessed her signing these. Seeing completion of this nearing I then left to supervise the dealer removal of accessories off our trade in truck as we had agreed upon (grill guard, bed extender, rail steps, smitty built roll bar and five KC lights, the tool box and bedliner).

We recieved the formal check out and explanation of all the new truck's features. We went home, surprised, and pleased at our negotiation skills. We cancelled our trade in auto insurance and upgraded our new policy for the truck and recieved our insurance card by fax. We verified that our down payment had successfully drafted.

We then showed off our truck. We made modification service contracts with a professional shop to install the retrieved accessories on our new truck, using what was possible and buying new when substitution was not wise.

We recieved a call from the salesman to come back to the dealership and visit with him. We agreed and happily drove in to meet him.

At that time a new man identifying himself as a junior finance person said that the truck we had bought had been negotiated in good faith, but in error as they believed they were talking about another truck than the one we drove off in. He then said that he could not finance the current vehicle and suggested that we return the truck to him for another truck "more like we thought we were talking about". I declined. He then said that we had a problem as he couldnt finance the vehicle as they had tried. He said they just couldnt put it through the way they had worked out with us and needed to come up with some solution. He suggested a considerably different, much larger cash payment to him in addition to the trade in and the two thousand dollars.

I paused, simply declined and told him that I would go home and think about everything he had said. I told him we were happy with our choices, but certainly did not want any person to be in trouble because of any errors and that we would as a couple talk about bringing them some extra cash. I told them we would be leaving town and that I would get back to him in ten days. We left.

The following night at ten pm the salesman and another man came to our security gated apartment and knocked on the door. I was at work. They said they had some problems and needed to talk and walked into the house together un invited with my 17 year old daughter present. They began swearing and talking about being screwed and how much trouble could be avoided if we just would give them back the truck, take our truck back and all part ways. My partner told them to leave, that she did not have the truck. They told her that because she did not have the truck they would be filing felony theft charges on her and me.

She came to my job. Crying she told me what happened. I said no problem honey, just give me the papers and Im sure we can work this out. This is probably some free lancing lower level employees scared for some reason and who just made some bad judgements. She then realized that she had left the dealership and was told to go ahead and leave her paperwork there so she could get the final copies when she came back to retrieve her new tags. I just about fainted. I had failed to double check this with her.

I talked with the junior sales man. He said that the only paper she had signed was called a bailment, something I had never heard of, and that there was no contract or promissary note, etc. I explained I had sat there and watched her sign all
