Sold 5th Wheel as New that their saleman had lived in for Months! Common Practice for them and can't fix anything right! And California

I will make this short as I can and at the end will include the list of repairs they are supposed to be doing even though we have repeatedly asked for our money back or a new 5th wheel. This is common practice for them and is clearly fraud. I will start by what I recently filed with the ag's office and add from there.
On March 18 we purchased what we believed to be a new gulfstream yellowstone 5th wheel paying cash for the unit. 3 days later, we went back to the lot to look at a truck, noticed it still there instead of gone to be prepped, they allowed entrance so we could measure the space available to place a tv. We noticed a few minor items that needed repair.

Very discouraged, the general manager, Kip Stoltzfus along with then sales mng Cliff Davis and our salesman Bob Strange took notes at what needed fixed, approx 4 items and Kip offered a $1200 gas card for our trouble and because the unit would take extra time to prepare for delivery. At that time Kip stated that it had been a customer demo - to me this meant simply customers going thru it and trying things like the faucets, etc to see how things worked.

In transferring our items from our trade in to this unit, we kept finding other things broken. They just stated to keep a list after living in it for a time and all would be taken care of. As soon as we parked it at the rv site in Mesa, we knew something was terribly wrong. The stench was so bad, we couldn't stand it. I have 3-4 pages of items - the holding tanks were just the beginning.

The trailer smelled so bad, you couldn't stay in it. I spent almost a week and alot of money in chemicals trying to clean ot the tanks they were so bad and never dumped. We knew at that time the unit had been used and I started asking around. I found out from their own salesmen that two of their salesmen had lived in this unit for 4 months while at a show in Quartzsite.

When confronted with the information, and requesting a new trailer like we purchased since this one was used - or our money back, it is their belief that no matter how long they allow their people to live in these that as long as they have never been registered, they can consider them new.

We have gone 6 months without being able to use the sink - a fungus is growing in the water lines. The kitchen tank was cracked, they replaced, but does not vent correctly so all the smell of the tank comes into the unit. They found a problem with the vent pipe, fixed that, it stilled smelled. Found where a part of the pipe was not glued, fixed it and it still smells. They didn't check the entire pipe though assuming they had it fixed. They don't.

They can't match the carpet for the slide that needs to be replaced since their repair was so bad so now they have to replace it in the entire coach.
They were originally supposed to replace the slide carpet, tried again to get by with just fixing it - and it got screwed up like everything else.

A few items have been repaired and there are many many more to do. They just sent paperwork that they are required to do on delivery they never did so I currently have no warranty and the checklist does not apply now. I cannot sign the warranty paper stating everything was fine on delivery and they refuse to fix anything until they are signed by me because they are turning it all into warranty to pay. We have requested from day one a new unit which is what we paid for or our money back but they refuse.

Now - they have refused to service us at all stating no matter what they do or offer, we just can't be satified apparently. That is because what little they have done, hasn't fixed anything. When they try, it remains broken. When it was in their bay for a week to supposedly fix everything, especially the water lines were to be replaced - a couple items of 3 pages got done because either parts did not come in or came in wrong which is an ongoing problem with this company. The parts dept continually orders the wrong parts.

Director of Service operations Buddy Rice told me they had replaced the water lines when he actually just had his men bleach the lines. Don't you think you would at least check to see if it fixed the problem if you are going to lie to customers? It didn't. The fungus was still there, still couldn't use the water.

This is a definate health issue between the water lines and the hydrogen sulfide coming out of the vents into the unit. I'm sure my husbands illness and my continual migraines are from this. Back to my nuerologist, they have upped my miracle medication that had made me migraine free for the first time in 20 years and now all that is lost.

Whether they now refuse to fix anything becuase they have heard from the ag's office I don't know. They owe us for items the warranty will not cover that is strictly damage from their salesman, which all of it is as far as I'm concerned anyway.

We tried a demand letter from an attorney for return of our money or a new unit but that got us nowhere. Kip had just lied stating we knew from the beginning it was a customer demo. I guess everyone is supposed to know that customer demo means salesman live in them for months. Makes sense to you doesn't it?

The annual Quartzsite show is in the next month or so again. These salesman live in rv's from their lot for 4-6 months while they sell others from them then they bring them back, clean them up and sell them to you and me as new. I was the big sucker that saw this floor plan after looking at dozens, was exhausted, loved the floor plan, was evening and did not go home to think about it overnight and come back in the daytime.

One of their comments was I got what I paid for - according to book not nearly! I really got taken. Not just being used, but the price.

I am willing to accept any advice from anyone, espcially the one with the toyhauler. You did a great job. I have let Beaudry know that I am not a typical woman / customer that they think will roll over and I am not giving up.

Repairs:
The holding tanks were not clean and the stench has been awful. We have been working since taking delivery on getting this cleared up.
The probes / sensors / fill indicators for all three tanks have not worked, nor did they work on the walk thru. Rocky, the person that did the walk thru had no explanation for this. We now know why, obviously.
The cold water in the bathroom faucet smells as if it comes straight from the black tank. All other cold and hot water is fine. This faucet is completely unusable.
The tank for the galley has a crack on the top of it.
The valves to the tanks do not completely close. They leak in the closed position. This is obviously a health hazard.

There are a number of patches on the underside of the trailer where there have been attempted / or fixes previously. I have no idea what these are or what they were for. One is awful and duct tape was used to tape completely across the unit and is falling apart. This new unit should not have required any repairs. The entire bottom is bowed out of the trailer.
The kitchen door (inside wood and glass) has an approximate by gouge out of it on the edge below the latch and the bottom edge is all messed up. The door stop is off. There are several scratches all over. It will not close with the other small door and is misaligned.

The porcelain grates on the stove top are completely scratched through the porcelain to the metal. Also the aluminum covers over the actual burners (3 burners), the finish is completely worn off from possibly scrubbing clean. They apparently had to clean so hard / much under the stove top it even took off the directions.
There were stress cracks on the back of the 5th wheel which your service dept sent someone out to fix. Also the rear bumper that someone had backed into.
The front of the 5th wheel overhang fiberglass had bubbled. The same company came out yesterday to fix while we were away. They were here late and left a mess of all the fiberglass shavings saying they would let the wind blow it away. It was everywhere in the morning and I spent my morning cleaning it all up. They are supposed to come back to finish sealing today. Still a no show.

The faucet in the kitchen and the shower assembly were completely calcified from use. They admitted they couldnt even get it clean.
None of the manuals were here.
The pleated blinds were dirty and spotted.
The drapes in the kitchen were spotted with something.
The door threshold to the outside is torn out from the floor.
The molding is loose from the wall.
You can see the outside from the inside from the door jamb.
Molding on outside of trailer does not run the length of the trim.
Sealant on roof missing in several places.
Exterior graphics shrunk I believe after doing the perma coat. There were big black swipes all over the coach where they either didnt wipe it off, or didnt put it on.
Hot and cold water in backwards in shower.
Drawer glide broken in dresser at foot of bed. Several screws missing from many drawer glides.
Water filter installed backwards. (We fixed)_
Kitchen table has a chunk out of wood on the end.
Kitchen fantastic fan? Doesnt work correctly. Manual only.
Carpet in living room coming apart.
Couch cushion edges are frayed.
Living room floor vent cover is completely scratched and a mess.
Bedroom cabinet over bed door hinge is broken and wood is cracked. Underneath is unfinished.
Plastic slide in screen door is too small. Does not fit.
Fender skirts do not align with body and coming apart from.
The back of the bathroom door is damaged where apparently a hook was removed.
Surround sound not hooked up with receiver.
Furniture not cleaned and inside not detailed.
Second battery missing.
Passage storage area not cleaned.
Lime deposits in kitchen sink and faucet.
Food odors in fridge and freezer. Shelf missing from freezer.
Spilled pop or something that splashed all over wall and door and drapes. Needed cleaned, they didnt do it. Was still there on the walk thru.
Finish wood under microwave unfinished.
Spots on dinette chairs.
Hearth below fireplace needs cleaned.
Curtain snap for tie is off behind sofa wall
Fabric panels in bed frame walls have holes.
Flashlight holder is broken from wall.
Latch for accordion door in bedroom is broken.
TV Antenna crank is broken.
Heat does not come thru floor vent to kitchen.
Air does not come thru roof vent to the kitchen.
Front door is broken on bottom, apparently from the threshold being broken?
Steps to exit the trailer are broken. It feels like you are falling out of the trailer trying to leave it.
Recliner is torn and dirty.
Linoleum in kitchen as nail heads poking thru.
Chip out of the shower stall floor.
Screen is missing in middle kitchen window.
Several window locks/latches are broken.
Propane and water not filled.
