Ripoff dishonest rude billing poor excuse for customer service

On 5/19/07, spoke with my account manager, Jerry regarding my account. He informed me that my account was behind but that if I made a payment I could utilize the deferment program by paying an addition $35.00 to the payment to bring my account current. I informed Jerry that I would make the payment online since it was free. Jerry informed me that I would need to call back after making the payment and inform customer service to separate the payment so that the deferment fee could go to the proper department.

I did as I was instructed and made a payment of $330 on the 23rd of May and called to let them know about separating the payment. The person I talked to let me know that there were no notes for the deferment and after placing me on hold found the notes and sent a message to the payment department to separate the payment. I did not hear anything from anybody until June 20. I received a call from someone saying the amount due was over $600 and I informed her that I did a deferment. She looked and said that the deferment was never processed. The next day, the 21th, a man called me saying that the deferment was processed but was reniged because the payment after that was late.

The next day, the 22st, a woman called me and I told her that I was trying to refinance because everybody keeps telling me something different every day. The next day, the 23rd, I spoke to someone named Jessica and she informed me that there were several notes to process the deferment but that noone ever did. She also informed me that it is Capital One's policy to allow 15 days for the deferment process and if the payment and the paperwork is not processed within that time frame that the account goes back to its original status and owing amount. I made the payment when I said I would. I called like I was informed to do. And the rest lied with Capital One.

Because they failed to process my paperwork, my account is now 60 days overdue and showing negatively on my credit report. Jessica also told me that the only way to get my account back in good standing was to borrow $178.18 plus the $35.00 deferment fee again and pay it. I don't have any money and I've been out of work for 30 days until the 22nd for medical reasons associated with my pregnancy. After the last 8 months of dealing with Capital One's rudeness, dishonesty, and lack of integrity, I am sick and tired of it.

I should be able to call on any given day and be told the same thing no matter who answers the phone. I should not be yelled at, hung up on, cursed out, or lied to especially because I don't treat people that way. All of this has been the case for the last 8 months with very few exceptions. I am 5 months pregnant and have been dealing with harrassing phone calls for 2 weeks now. Who do these people think they are? And how can they legally get away with this?
