Claims to warrant mileage computers but cancel the policy when it fails

I purchased an extended warranty from Continental Warranty on July 9 for my 2000 Jaguar XJ8 based on the understanding that major mechanical and hi-tech electrical components would be covered. On August 11 my vehicle had to be towed to the local Jaguar dealership because nearly all of the warning lights remained on, the digital odometer was blank with a static line, and the vehicle would not shift out of park.

I contacted both Jaguar Roadside Assistance and Continental Roadside Assistance that morning. Continental Roadside Assistance confirmed my warranty and dispatched a tow truck. The vehicle was delivered to the local dealership that morning at approximately 10:30 AM. A diagnostic check was attempted on the vehicle, however, it failed to recognize all but two computer modules.

Assistance from the Jaguar factory was requested by the local dealership, but no repair solution was reached. The only true solution reached was to replace the entire console (or as referred to in the warranty booklet as electronic instrument cluster and which also includes the mileage computer).

This is where I believe the company failed in it's obligation to honor my warranty. When the local dealership called for approval, the request was denied because a reading of the mileage was not available. This was due to the fact that it was part of the diagnostics that was not being read by the diagnostic check.

Under the terms used in the warranty booklet on page 7, the mileage computer is covered. However, also used in the booklet on page 13 under CANCELLATION OF AGREEMENT, the statement of 2. Your vehicle's odometer is disconnected or altered or the true and actual mileage cannot be determined. Is in direct contradiction to the terms of the agreement/warranty of the items covered under the FREEDOM PLUS PLAN COVERAGE items. If the mileage computer fails, how is one to obtain a true and actual mileage reading?

On July 11, my vehicle was at the dealership to have a Mass Air Flow Meter/Sensor replaced. (exactly 32 days prior). The reading on the odometer was 54,060 (Dealership Invoice, dated 11 July 06). Based on the month/year of the vehicle (Oct) and the number of miles registered on 11 July, a monthly average of 783.4782609 is obtained. However, I did advise Continental Warranty and that my most current recollection of my odometer reading was 55,3* just prior to 11 August. I mentioned this in good faith and honesty as a consumer.

My warranty was for four (4) years or 80,000 miles (whichever is sooner). Under the circumstances, I believe that Continental Warranty can and should be able to work with both the dealership and I to resolve the issue.
