Ripoff warranty, would not pay my claim although covered under warranty

Below is a copy of the letter I have sent to Warrantech Automotive Inc.

I am writing in regards to a Level 1 Vehicle Warranty that I purchased for my vehicle on July 23. The warranty remains in effect. Recently, I noticed the transmission was not operating properly. As such, I called Warrantech's customer service line about bringing my vehicle in for service and I was instructed to take it to a local transmission service station and call Warrantech if they determined repairs would be necessary.

On June 19, at the advice of Warrantech, I brought the vehicle to Mr. Transmission service station (Transmission). After inspecting the vehicle, Transmission determined the bearings needed to be replaced, which they stated was a common defect in this particular model vehicle. Transmission contacted Warrantech to report the claim.in response, Warrantech informed Transmission that it would have to disassemble the transmission to allow one of its inspectors to come out and approve the repairs.

On June 23, I was contacted by Transmission and was informed that Warrantech had denied my repair claim. That same day, I called Warrentech's customer service line and was forwarded to Angel Gonzolez, an inspector with the Inspection Department. Mr. Gonzolez stated that the inspection report indicated that the clutch plates and other parts showed possible evidence of overheating. The report also stated that overheating may have been caused from driving with low transmission fluid (possibly the result of a seal that showed evidence of leakage). Because of this, the inspector apparently determined that I negligently failed to service the vehicle, thereby causing it to overheat. As a result, my claim was denied.

As I explained to Mr. Gonzolez, I am a U.S. Army trained and certified mechanic with ample experience in servicing motor vehicles for the U.S. Army. I also perform the general maintenance service on my own vehicles. Not only have I been diligent in servicing this vehicle, but I can provide receipts to verify the services performed. Mr. Gonzolez could not explain Warrantech's failure to contact me regarding any alleged negligence, nor did he allow me the opportunity to supplement the improper denial with evidence that the vehicle has been properly maintained. Moreover, knowing that I had maintained all fluid levels and performed all necessary maintenance on my vehicle, I personally contacted the mechanic at Transmission to determine the cause of the damage.

Not surprisingly, Rick Moreland, the Transmission mechanic performing the service on my vehicle, stated that the cause of the transmission failure was the result of normal transmission bearing wear, a problem that is very common in the model of my vehicle and not caused by failure to properly maintain the car or owner negligence. Please review the pictures attached (that indicate the bearing wear) and the signed statement of Mr. Moreland.

I am confident that this dispute can be resolved amicably. I am simply requesting that Warrentech properly cover my claim pursuant to the contract. Please contact me immediately, since I have been without a vehicle for nine days.
