Dishonest fraudulent business practices, refusing to pay debt obligations

Mid-Ohio Collision agreed to repair my automobile, paid by my insurance company, and they would pay for the rental car they arranged for me while they worked on my vehicle. I was only responsible for my Insurance deductible; Mid-Ohio Collision had the rental car billed directly to them. Over 1 year later, I am being contacted by attorneys representing Hertz for collections of this rental car bill that is still unpaid by Mid-Ohio Collision.

Mid-Ohio Collision cold called me about repairs for my car promising to cover my deductible or cover the rental car. They agreed to pay for the rental car, and have it directly billed to them, while they had my vehicle for the repairs.

Mid-Ohio Collision had my vehicle for repairs from 2/24/05 to 3/24/05. After my car was finished, I returned the rental car to Mid-Ohio Collision, as instructed, and picked up my car. Since the rental car agreement had the charges billed directly to Mid-Ohio Collision, as they promised they would pay for the rental car, I never received any additional paperwork or bills from the Hertz Car Rental Company.

Over 1 year after the repairs, I now have received phone calls from an attorney representing Hertz attempting to collect the unpaid charges for the car rental that was billed to Mid-Ohio Collision. Mid-Ohio Collision was billed on their account as they agreed; however, they failed to pay their account with Hertz, and were turned in to Collections with this same law firm. After the law firm was unable to collect the unpaid bills from Mid-Ohio Collision, they are now going after the consumers who were on the rental car agreements as the drivers of the rental cars, even though Mid-Ohio Collision is responsible for these unpaid bills and refuse to pay.

Information I have received shows a statement from Hertz to Mid-Ohio Collision for the unpaid bills of 13 different car rentals between the dates of 2/4/05 and 4/12/05 (including my rental) for a total of $7125.35. This shows that Mid-Ohio Collision had promised and is obligated to pay the car rentals of at least these 13 customers, and Mid-Ohio Collision is refusing to pay their bills.

My Hertz rental car agreement specifically states the charges are to be directly billed to the Mid-Ohio Account number for Hertz.

I attempted to contact Mid-Ohio Collision on at least 3 separate dates after I was informed of these unpaid bills by Mid-Ohio Collision, and the attempts from the Collections attorneys to make me pay for their unpaid bills. Each time, I was informed that the owner, Nic Cimino would need to look into this issue, and was assured that he would call me back. I still have never received a call back from anyone at Mid-Ohio Collision regarding these unpaid bills. I left messages for them to call me back before I had to respond to the collections attorneys for Hertz, and I asked them to resolve this matter before I had to take the necessary actions to file formal complaints against them.
