We had bought a Kia in September. Due to medical, we were often slow pay.in October we had requested for a 2 month loan extension and were asked to fax the request. I believe I spoke with a lady named Terri. I faxed it in.

Two days later I get a call at work looking for the late payment. I told whomever I spoke with I had faxed in the request and was informed no one had received it. So, I faxed it again and checked the fax machine to ensure the document had gone through. I called back and they said it was being processed. My understanding was I would be able to skip the November and December payment and resume in January.

Approximately January 6, a tow truck shows up at the house to repossess the car. We surrendered it and I contacted Triad the following morning. I was told they had not received the September or October payment. I faxed over the bank statement showing where the payments had been deducted from my bank account.

In all future correspondence, they referred to "locating" the September payment but nothing was ever mentioned about the October payment. I was again told they had never received my fax requesting the extention. I faxed in the copy of the fax transmission page showing my fax had gone through successfully.

I still have e-mail correspondence with Sergio Padilla in which Triad agreed to not report the repossession against my credit and after selling the car at auction for less than what was owed, he agreed Triad would not come back for the delinquent amount still owed.

During the time Triad had my note, they called my brother, had my 87 year old grandmother in tears over what a deadbeat we were and she gave them my new home number. They also called my neighbor and tried to convince here there was an emergency and she needed to give them my number (we didn't have a phone during this time, due to illness).

They called my boss and told him how awful we were about making our payments. If the payment was one day late the phone calls started and there was no such thing as "i can't do it this week, next week after I get paid." Granted, I understand it was my obligation, but knowing my neighbors were being contacted and told it was an emergency of some sorts or disclosing our payment history with them was beyond humiliating— not to mention the guerilla warfare collections we were subjected to. Oh, and they still, to this day, never acknowledged they had received the October payment.
