West Valley Ripoff, fraudulent contracts and approvals

We went to Ken Garf looking for a minivan for about $5k. It was very important to us that it seat eight, or atleast be equipped so that we could order the seat and install it ourselves.

Ken Garf contacted US via an application submitted through eLoans.com saying we had already been approved. So we went to the dealership. There we were told that we could get a 2005 Pontiac SV6, a beautiful vehicle. It did not have eight seats, but was equipped for them. Our payment instead of the $180 payment we were used to on our van which was wrecked, was more than doubled to $550. We could still make the payments although it would be tight. We signed paperwork, got the "good luck and congrats" handshake from the salesman, and we were on our way. The van was still under warranty so we took it in for a bad DVD player, which was replaced.

Fast forward thirteen days, we get a call from Ken Garf saying we need to come in and meet with them. They didn't even tell us what it was about, not even that much honesty. So I flat out asked and they say the financing was denied and we need to bring it back. But wait, we were approved, the only thing we were told is that we MIGHT have to come back in to sign "Final documents" if they got a better contract with a different financer. But don't worry they say. We will put you in something.

We don't need something, we need a specific vehicle, and they don't have it. So we went to another dealship and bought a 2005 Chevy Uplander, the same van different maker. Then we took the van back to Ken Garf. According to the contract they had broken it by not notifying us within seven business days if the financing didn't go through. We showed up and handed them the keys. Then they say we are going to have to pay milage out of the $1,400 we already put down. But don't worry he says it will be reasonable. So we are expecting anything up to a hundred dollars.

He calls us the next day and says the milage is over $700. What?!! You have got to be kidding us, we are not paying that. But we are not in a bargaining position. They have our money that we need for the down payment on the new van, and we get nothing until we agree. So we talk them down to $375. They will not go lower.

They broke the contract, and yet they keep insisting that we did by not allowing them to put us in a vehicle we don't want after they broke the contract and made us bring the van back.

The day we got the call to bring the van back I literally sat down and cried. I loved that van. It was beautiful. I named it Albatross, because it would be a blessing to our large family, and a curse because of the payments. I couldn't look back as we drove away. I was in a van I didn't want, being charged a fortune because they broke the contract.

This is a scam, they do this on purpose. They show you vehicles you will never be approved for and make you fall in love with one. Who doesn't want a newer car, a car that is more reliable? They can tell you can't afford it, they can tell by what you drive now, how you dress, how you style your hair. They are trained in this. They can smell blood in the water. The thousand plus miles we put on the van didn't decrease it's value at all. They broke the contract, taking longer than allowed to ensure we would put more miles on it and then charged us way WAY over what is allowed for a per milage rate. They knew we couldn't fight it, they had our money.

I am not taking this lying down. After this mess I remembered the complaints, and if people will e-mail me we are going to go to Bill Gephardt of Channel 2.
