Breach of Contract Beware Consumer's, Don't Sign Until Final, Don't Take The Car Without Proof of Financing ripoff

Hello thank you for taking a moment to read my report!

To start my wife and I are seeking the help of an attorney for the purpose of a contract signing for an automobile. On the 20th of December. I (Michael) went to a local dealership in Arlington, Texas. I found a nice 2003 Jeep Grand Cherokee that I would buy on contract via financing. That evening of the 20th, I was only able to sign the buyers agreement (Not The Contract) to take the vehicle off the lot. My wife was at work that evening and she was unable to sign anything, so we had to return the next morning the 21st to sign the contract together. That evening of the 20th, I asked about obtaining the financing. The F&I person, Keith Kay, said he would have a definite answer for us on the following morning when we both come back to sign the contract. So I left the lot that evening with the vehicle.

The morning of the 21st, my spouse and I (as agreed) in the buyers order, proceeded to sign the contract for the car. I asked again about the financing. Keith said it's all taken care of congratulations on your purchase, do you like it? Responding yes, he said, your both good to go enjoy your new car. So we signed the contract and left with our new Jeep.

On the 29th of December another F&I person named Greg calls up and says we have to bring the Jeep back, because financing fell through. We stated we have a contract. He said yes, but without financing you can't keep the car. We were able to obtain our trade back, which was up for sale on the lot, detailed, inspected and tagged ready to sell to anyone. I took the Jeep back to the dealership walked into Keith's office and placed the keys on his desk. He responded with, what's the matter? Why are you returning the Jeep we already got everything done for you? I thought Greg was handling everything with your account? I said apparently not, you people called me back after 9 days and said to bring the Jeep back because financing fell through.

After that was over, I proceeded home and called an attorney in Plano, he was a contract attorney who was able to answer my questions. Apparently, I should have never brought the Jeep back to them, for there was a signed contract that stated deal was finalized and that I now, owned the Jeep. A clause in the financing contract stated, financing would be obtained through a bank after 2 days, not 9 or 10. The attorney stated, if the financing was not through a bank, then it would have to be obtained through the dealership.in which case payments are made to them, yet they were not and frankly I would not recommend this to anyone to keep the car.

Two days after this event I contacted a friend of mine in New York who is a finance F&I auto person also, he stated that if I signed the contract with my wife and they also signed then the car is mine. I faxed the deal to him to have it reviewed to make sure and yes we bought a car, but we had to take it back.By contract that is binding, that is our car. I called the dealership back at least 3 different times left messages on what the attorney provided me with in addition to the finance friend in NY, and still no responses.

I think we have a case here? I have talked to numerous resources attorneys, friends, other dealerships in the area and they all say the same thing, lawsuit! In fact on a recent blog I saw on the internet, a person form Ft. Worth said in the State of Texas if you sign a contract for the vehicle and they signed then the car is yours!

My Jeep, is now up for sale at Vandergriff Toyota in Arlington, TX and time is running out. I should've never taken it back! Consumers of Vandergriff just be aware that they are very dishonest people. When they say they can get you done in 10 mins., firstly don't believe that and don't sign anything or take the vehicle until proof of financing has been arranged! They will try and get away with something I think in my opinion is borderline fraud.
