Mel Clayton Ford lied to me about their contract. I had recently purchased a 2005 Ford Escape, however 2 days later my financing fell through. I talked to their financing department about bringing back the car, per the contract and they claimed that I was in default of the contract. I asked to talk to the Sales Manager, a person by the name of John Loviteer. He said, on the phone that I could bring back the vehicle and get my trade-in vehicle back, however when I showed up at the dealership, he changed his story. He claimed that he had 30 days to obtain financing, per the Arizona Revised Statues.

When I asked where that information was in the contract that I had signed he admitted that it wasn't in there, however it was an AZ Law. Well, I wasn't going to take his word for it, so my grandfather pursued this with the Attorney General's office. After reviewing the contract, they said that there was no evidence of the 30 days for financing and told him to immediately contact his lawyer. Why? Because there was some fraudulent stuff going on.

My grandfather and I went to the dealership to return the car and get my vehicle back, but they only agreed to do so when my grandfather said that he was a journalist and was going to leak this to the press and we would take legal action. They did not want this to happen so they agreed to recind the contract. I then signed a paper that stated that the contract was recinded due to the fact that I could not obtain financing.

However, when the loan officer told a valet to get my car from their "bullpen", he could not locate it. They had already sent it off, without the title no less, to an auction house. Now I ask... How can they legal do this? How do these people get away with all the lies and deceit? I will make sure that I let it be known that they will not get away with this... No matter who I have to contact.

Mel Clayton Ford will pay and they will not be able to take advantage of anyone else. If you are thinking of purchasing a car at Mel Clayton Ford or anywhere else, just remember that if the dealer says something that is not in the contract, you are not bound by that. You don't have to sign more than one contract if you don't want to. Please learn from my experience.
