On August 18 we purchased a car from this dealership using $3,000 down payment. Approx three weeks and 4 days later we went to get the tag. Tag office had received NO title paperwork. Called dealership, they said it was taking longer to get in, issued another 30 temp tag (since our expired in 3 days).
Waited until September 28th and remembered our first car payment was due October 2 and we hadn't received anything in the mail from finance company. Called finance manager and explained. FM called us back three days later to come in. Explained previous finance manager had quit three weeks prior and NEVER mailed our finance packet to bank. Since it had been longer than 30 days... The approval from bank was void and thus the deal never got processed. He had to run again like a new deal. Would run numbers with banks and call us to come back and sign papers again.
Called us three days later and said they could only get funding through another bank and the price went up. We haggled for 2 hours and ended up having a higher interest rate and higher payment but whatever. Signed new papers October 7th left dealership thinking all was done. Received call from FM October 15th that deal was denied, needed to bring car back. We brought car the next day afterwork (sat) and was told that no one was available Saturday to cut checks... Needed to wait until Monday. We called 3 times Monday for them to have check ready and everything so we can get it over with. Arrived to be told we would need to pay. 15 per mile for the use of the vehicle according to Bailment Agreement. Bailment Agreement was signed October 7th but the FM put the milage according to the August contract... Not October contract. Said we needed to pay $800 and not only that, wouldn't cut us a check until next day for remaining amount. Said person who signs checks was gone.
Took keys from us for the vehicle and left us sitting in lobby with no car and no $3000 check. Owner Scott Evans came in and went into FM and GM's office and they relayed to us this milage cost would not be waived. Threatened to call police if we didn't leave, they would get us a check when they could. Police were called, agreed that second contract was null and void since they put the wrong milage reading but could not enforce. Referred us to magistrate court. Plus, no Bailment agreement on first contract in August. Only for October contract which was dated October 6th and today is October 18th. NO WAY we put 5,000 in one week. Refuses to talk, acknowledge their wrongdoing and refuses to give our $3000 back.
