On January 8 my wife and I recived an E-mail from Vista Chevrolet stating that we were preapproved for a new vehicle.
Later that evening we went to the dealership and talked to a salesman about buying a used truck. After looking around on the lot we found a 00 Tundra.
I told the salesman that we had no money for a down payment and that we could only afford $350/month, so he told us that he would see what he could do.
He soon returned and told us that he could get me in to the truck for $335/month with no down payment. He told me that they have a program for military and thats how he got me the deal.
So I go to the finance office and they write up the contract (0 down $344.44/month 12.9%). On the contract the finance office had me sign the "NOTICE OF RESCISSION RIGHTS" and on the back of the contract it states that the dealership has 15 days to notify me by certified mail that they cannot assign the contract to a financial institution and I have to return the vehicle.
We have had the vehicle for over the 15 day period and heard nothing. On the 16th day after the contract had been written I recieved a call from the dealership saying that I needed to come in to see someone in finance, I agreed and set up an appointment for later that day.
When I arrived at the dealership I was confronted by the salesman and was told that the person that wrote the contract had messed up because they no longer have the military program and now I need to produce a co-signer and if I cannot or the co-signers credit is not approved I will have to return the vehicle.
At this point my wife and I were very angry, so I decided to consult an attorney for advice. I went to a legal assistance program that is located on base, and talked with an attorney to find out what I could do. I was told that I had done nothing to default the contract and the dealer should have notified me before the 15 day period had passed, and suggested that I should return the vehicle to avoid any more problems.
I decided to wait and see if I recieved any notification that the contract had not been approved.
On the 26 of January I was called at work by the dealership and was very rudely told that I was driving one of THEIR CARS and I needed to come in right now and return it. I told them that I would come in after work.
I arrived at the dealership and had to wait 15 min. For someone to even talk to me, finally someone came out and asked me what I was doing here. I told him that I was here to return the vehicle, He acted like he didnt know what was going on and took the keys and told me to hold on. After another 15 min. He returned with the salesman. The salesman approched me with his hand extended expecting me to shake his hand like there was no problem. I refused to shake his hand and he then got angry and started to tell me that it wasnt his fault and then he called me a "PRICK", and walked away. The other salesman was still standing there an I asked him if there is any thing that they were willing to do to refund me for the insurance that I had purchased and he told me that I was "S*! T OUT OF LUCK".
I then asked him to speak with the manager, that was standing outside, he went outside for a few minutes and returned and told me that he refused to speek with me.
I walked out of the dealership and while standing at the car the salesman (that took the keys) told me that a down payment was important. I told him that they should have figured that out before they completed the contract, he then told me that I was young and I would bounce back.
I have never been so disrespected in my life. For these people to take advantage of anyone in this manner is just wrong and they should pay. I will be filing suit in the extreme future.
