These guys have been trying to collect a debt that is 10 yrs old. They continually call, several times a day. A man who goes by "Charles Brown" (and several other individuals) have used profanity, have called me a "low-life" and an "asshole" telling me I have to pay this debt. They hve threatened me by stating they would contact my mortgage co. Regarding this debt.
They have refused to tell me who the 'creditor' is on the debt. I've recently gotten them to tell me when they purchased this debt, which, by law, they have to do.
I did find out some information, though. If the date of the last payment made on a debt is 7 yrs old or greater, they are "Past Statute" and it is illegal for them to try and collect the debt.
Inform them that they are in violation of the FDCPA (Fair Debt Collection Payment Act) and if they contact you in any way from the date of your notice of violation, tell them you will take legal action.
Document everything they say, threaten, etc. With date/time and name of the individual. Also be sure to obtain the full company name, address and phone, plus the name/spelling of the individual that is contacting you.
I was told that if you win your case, they will be required to pay "YOU" the amount of the debt.
