Portfolio Recovery Associates buys old consumer debt and tries to collect on it. The problem is, they try to collect on debt that is outside the statute of limitations without providing any documentation indicating who the original creditor is. They contacted me about a supposed debt from 2000. I know it was from 2000 because I had not lived at the address they had on file in over eight years.
Up until two months ago, no agency has ever contacted me about an outstanding debt. I have repeatedly asked PRA to provide me with the name of the original creditor but they will only provide the name of a company called EMCC Inc. I looked up this company online and it is another debt collection company. I have no idea if I actually incurred a debt or not.
I have spent the last twenty years establishing an excellent credit record and now this company has threatened to destroy my credit without providing me with any documentation from a debt that supposedly took place more than eight years ago.
I have filed a report with the FTC regarding this company and am in the process of responding with a certified mail response to their repeated attempts to contact me.
Folks, do not pay this company a single dime before doing thorough research! In most cases, you do not have to pay the debt if it is outside the statute of limitations (they vary by state). PRA also must provide you with the following:
- the nature of the alleged debt
- the accounting explaining how the debt was calculated
- contracts or documents that form a basis for the debt
- the name and address of the original creditor (not a debt reseller)
