I have been fighting Fairbanks since they bought my house note back in 1997.in reading these numerous rip off reports, I can see that all others have gone through the same nightmare that I have.
They started by saying I had missed payments, and no matter how much proof I furnished they kept adding up charges against me. Then they sent foreclosure letters twice each month (each with different amounts?) and would NOT tell me what the amounts were for! Finally they sent a letter and stopped accepting my payments. This went on for months with me calling every day and begging for an accounting.
One of the saddest parts of all is that here in Texas, I could not find one single attorney that was aware of Fairbanks and their deceptive practices, or one that would even take the time to read the consumer complaintss I was furnishing! They naturally assumed it was me, and not a major company that could be in the wrong! I have written to our Attorney General and Congressmen, but just get a written responce that the company is being investigated! That does not help me to save my home! I need help NOW!
All their bogus charges, which include the payments they have FORCED me into not making, late fees and attorney fees have now totaled nearly $23,000.00.
Just recently GMAC obtained my note from Fairbanks and I thought that being a reputable company I could at least get the to make some sense of the Fairbanks mess, but they just have the records of Fairbanks and see me as deliquent and more or less a deadbeat!
I have lived in my home for 20 years and have considerable equity, yet I am going to loose my home on the 7th of September, if I do not file for bankruptcy, because there is not one single person in Texas that will help me fight what this terrible company has done!!!
By the way, as I sit here I have seen 3 cars drive by looking at my home because the notice for foreclosure has been posted at the courthouse!
