"a Gmac Company" ripoff

In october homecomings bought my loan, and it has been nothing but a nightmare.in july we were forced into chapter 13 bankruptcy-because of a failed business. We paid our payments, and because we are in a chapter 13, we have not received statements or any paperwork, except tax papers-to file for how much we paid for taxes on our loan...

In january of we found a company who would refinance us, so we could get out of the bankruptcy, and this is when all hell broke loose. When homecomings got this note, it was for $120,000.00, now not even 4 years later, we get the payoff, and it is $146,000.00!! We have already paid them over $25,000.00 in interest, and they are saying we owe them $26,000.00 of unpaid interest on top of the principal amount of $119,000.00... And it is also saying that we are next due for august!

I have been digging and digging deep to find all the receipts of payments, and because it is almost 4 years after the fact, and had i known that this was going on, i could have provided every payment paid... But because i wasn't receiving statements, i had no clue that this was going on... And then i request a payment history... And the only thing that makes any sense to me, is the fact that they added hazard insurance (1 year in the amount of $1721.00, and the other three are for $1271.00 each) when in fact i have always carried homeowners on my house and have just found proof of them-after digging in the attic in previous years tax papers.

I am about ready to have a nervous breakdown, and i am at a point of knowing that something needs to be done, but don't know where to turn... And one other very important factor is, that there is no lien on my house. Homecomings never filed paperwork in the town records, and because i am in a bankruptcy-they can't file it... So they should be listed as an "unsecured creditor"... And like i told my bankruptcy lawyer, if i was indeed 2 years behind on my mortgage payments (which i am not!), and they could have foreclosed on my home, they would have... They are moral-less, and every person i talk to there, has a different story!

My account was not coded correctly when i went into bankruptcy, and when i filed bankruptcy, i included 4 payments to be paid thru the trustee and then i added the 4 payments i sent in, and they applied to hazard insurance, this equals 8 payments i should be behind as far as thier records are concerned, and can't for the life of me figure out how they are coming up with next due for august! And can't imagine how they think they are entitled to over $50,000.00 of interest on a loan that isn't even 4 years old!

I don't want to lose my home... It's not just my house, it is my home, my son's home, and i run a daycare out of it, and am 40 years old, and can't imagine starting over... This is killing me... I am having anxiety attacks, and have nightmares that i lose my home!

If anyone can give me some kind of idea as to where to turn, or what to do, i would greatly appreciate it.
I know that God is stronger then the devil, and this world is corrupt, and i can't imagine how these crooks sleep at night, and one would think they should be the ones having the nightmares!
