Ripoff Predatory Lenders tried to steal my house from me

During the first 6 months of 2001 they redirected 3 house payments without informing us. We had sent each months payment in less than 15 days late as usual.

We had been paying our mortgage to them for 4 years and had always paid the property taxes plus the late fees when we got our tax return. This was never a problem until 2001.in Feb. They took our payment and applied it to our first half property tax payment without notifying us and then made our payment delinquent. When we received our March statement it showed no payment for Feb but without an explanation. So as usual we assumed that it reflected the 15 days late that our payment was.

Next we had a problem with a local insurance agent that had set us up with a great deal for the house and auto insurance all in one, only to have the insurance company not like something on our history and they cancelled. Of course the company we had been with now wanted a big start-up fee to get back with them.

HomeEQ got wind of the snag in the insurance arrangements and took our April payment again without our knowledge and used it to assign escrow insurance.

When we got our statement again no mention of the redirection. So we were still unaware of the growing threat.

Later on we find out that about this time HomeEQ starts sending a photographer out once a month to take pictures of our home so they can document any changes in there target. This of course
was added on to our account at $100 each set of photos.

The final straw was when they redirected August payment to pay second half of property taxes that were not due until Sept. 30 that is a month early. Now they had us 3 months delinquent and we received a notice of foreclosure.

We were stunned, how could this be? We made our payments every month. They had us over a barrel because in the mortgage contract it was said that property taxes had to be on time and insurance in effect. The fact that they never had a problem before with our setup made no difference.

We are still in Chapter 13 for another couple of years and it cost us almost $7000 to HomeEQ for there outrageous fees for each second of time and drop of ink they wasted in an attempt to steal our house or at least rob us of some money. Add to that attorney fees and Bankruptcy court costs what a pain in our ^&%^.

We believe what prompted them to go for the throat was our attempt to refinance elsewhere. Because when they got info petitions from the other company that is when all hell broke loose.

We have heard from a few different sources that getting out from under HomeEQ is worse than pulling teeth. So after bankruptcy is done then we get to look forward to that.
