Capital One Auto Loan CAPITAL ONE AUTO FINANCE reposessed my SUV before I knew who financed the car because Desert Dodge gave them the wrong address and phone number

I purchased a Dodge Durango from Desert Dodge in Las Vegas. They told me the financing was a "Done Deal", without a downpayment except for the $1500. They said they were giving me for a trade on a Buicki Roadmaster. I took the SUV then received a call a month later stating that I had to come up with another $1000.00 or I couldn't get financing. (A 700 credit rating until my divorce in 2000 when my x locked me out of my house, bank accounts, and mail... Another report for another time.)

They also told me that I had to prove more monthly income. D Dodge filed out the financial info on me. They had check stubs. They inflated my income. I've learned since that this is one of their scams.in order to prove more income I had to wait for a check from teaching Summer School which didn't come until Aug. 25. When I took them the proof on August 27th, I gave "Sky", the salesman I dealt with, my new address. Because I'd received several letters denying me credit, I didn't know who was financing my auto.

I kept asking "Sky" who was financing the auto and what the interest rate was, but he would dance around the question and never give me a straight answer. HE kept telling me that this is what I have to do to rebuild my good credit and in a year I could refinance or buy another vehicle at a good rate. I believed he didn't know at that point but I was out a car that was paid for and $1000.00. I really didn't have any options at this point.

Dodge said they would call me when the papers were ready. Backing up to earlier that day, a salesman who worked as a partner with "Sky" King, left a nasty note on my voicemail stating that if I didn't bring the financial documents to them immediately, he would come and get my SUV. It just so happened that I was on the way to the dealer to take this ADDITIONAL paystub when I heard the message.

This little sniveling creep didn't know what he was talking about since I'd never dealt with him during the entire 2 months it took them to finally get the deal done. I was completely upfront about everything financially with these people but "Sky" apparently did some creative financing to get me this loan.

I have since learned that this is one of their scams. When I got to the dealer this twerp thought he was going to verbally attack me and make me cry or something when I simply refused to talk with him, and insisted on talking to his boss. To make a long story short, his boss was very apologetic when I told him that I had previously furnished all the required financial documents and the summer school paytub was an an additional paper that wasn't available until the afternoon of August 25-also the FIRST DAY of school - and this was 2 days later. He was lead to believe that I'd been driving this SUV for a month without furnishing ANY of the required financial documents.

When he heard the entire story of why I was there in the first place, he was very apologetic. I believe this turd intentionally changed the phone # area code on the application and didn't change my address to the new one to cause these problems. Suddenly the Dodge dealership doesn't have my phone number? What are the chances. Another report for another time.

Capital One was given my new address on 3 other occasions by three different people and still failed to send me the information necessary to make my car payment. The fact that they were dialing 707 (Northern California) instead of 702 (Las Vegas, Nevada) area code and couldn't figure this out, only further shows their ignorance or intentional rip off. What idiot spends thousands of dollars on car, including new $500.00 tires, insurance, $450.00 tags and tax, then doesn't make a payment? What Capital One has done is either an intentional rip off or they're too incompetent not be sued.

As I was leaving for work Tuesday @ 6:45 AM, a tow truck blocked me in my drive, put a metal thing under the backend of my car so I couldn't move, and proceeded to tell me that he was taking my car. When I told him that I did not know who the finance company was to pay my paynment, he told me Capital One and said he would wait if I wanted to get them on the phone. Well, as you can guess, the minute I left my SUV and went inside the house he took off with my car.

When I finally found the number for Capital One, they said I was 60 days late on my payments. It didn't matter that they had never sent any financial papers to my new address-they in fact said they didn't have my new address. HOW DID THEY KNOW WHERE TO FIND MY SUV TO REPO IT IF THEY DIDN'T HAVE MY ADDRESS???

I can prove that they had my correct address at least 30 days ago because of the insurance company's notice that I had full coverage insurance. My sister also gave Shavon-Capital one's representative, my new address three weeks ago. HOW can I make a car payment when the dealer says the papers aren't in yet and I don't receive the sales contract until September 29th when I finally drove 1/2 way across the desert to the company and demand that they get them NOW.

When I paid two payments of $500.00 in August and September to the dealer I should have been covered at least until October. I received the papers on the SUV on September 29th, 6 weeks ago, and my car was repo'd for being 60 days late. When I called my sister for chit chat, she told me that Shavon called and she was going to send me the information so I could pay my car payment now that she had my new address. When I hadn't received it 2 weeks later, (this past Monday,) I called my sister and asked her if she could find the number on her caller ID or remember the name of the company. When I said "Bank One", she thought that was the right company. She did not have the phone number. I tried to call Desert Dodge but SKY was with another sucker or customer and never returned my call.

If anyone can help me please call (702) 292-3837 or e-mail me at [email protected]. I'm sure Capital One thinks I'm an old lady with no one to help me and no money or car to help myself. I will hound this company and Desert Dodge until the cows come home-and in the desert, that could take a loooooooooong time.

Since my car was towed Tuesday AM (11/18/03), I have called Capital one over 16 times. At one time on Tuesday afternoon, ZANE, came on the line and told me that "We can reinstate your loan-HOLD". 1/2 hour later, the bell rang and I had to teach my class. Since then, I have received voice mail promising to get back with me in 1 BUSINESS DAY. It is 6PM Thursday, and I haven't heard a word from ZANE.

Each time I leave a voice message I plead with him to return my call. I am currently renting a car and have paid out $350.00 for rental and deposit fees. I could have lost my teaching job when I was left 25 miles from school with no way to get to work. My roommate was reprimanded because he left work to get me in the classroom on time. This isn't right. I need help if anyone out there has been through this can you tell me what I should do. Thanks
