I have been in bankruptcy, with Fairbanks being included in the process... I have recently paid off the bankruptcy and have been paying along the way with Fairbanks... However, I had two accounts with Fairbanks and they confused the payments and tried to foreclose on me several times during the bankruptcy protection. They took me to court several times and were thrown out every time by the judge of the Middle Georgia bankruptcy court. However, I had to get off work and prove to them that I was up to date, due to an officer of the company telling me that I was ahead on the payments because of misapplying them to the wrong account.
Long story short, I have paid off the first loan with a short pay request and now I am being charged extra to pay off this account. It is in the base payoff range of $45K. They (Fairbanks) have charged me an extra interest amount of almost $20K, making it a payoff of $59,900... This is illegal, to charge me fees during the bankruptcy... I have asked for a short pay (which I don't believe in) just to get out from under them. They are horrible...
I was contacted by Country Loan Company to help me get out from under them and am running into problems with them trying to get satisfaction...
I am tired of dealing with them and if you can do anything to get my loan away from them, I would appreciate it. I have been calling and talking to loan resolution. However, I was only recently served notice that they were trying to get the house out of Chapter 13 bankruptcy... We are past that now, as I was released from bankruptcy on the 28th of October.
I can't afford a lawyer at this time... I will try in the future to sue them for the pain and suffering and the worst customer service organization in the world. How can a US company treat us like Iraq?
Please help.
