Wells Fargo misleading loss mitigation information

Last year I filed chapter 13 after several attempts to modify my loan with Wells Fargo. My loan was sold from WAMU to Wells Fargo at end of 2006. I had a modification with Wamu that apparently was not finalized when it was sold.

I did not know this until my payments to Wells Fargo were not being applied to my loan. After several conversations with representitives It was apparent that a new modification should be made. This took over ayear to try to do. During the process I had car repairs that put me behind 2 months. I sent a check in before the 3rd payment was due for 3 months and the check was returned with a letter stating I was in foreclosure.

I contacted Wells Fargo immediately and was told I was eleven payments behind. This steming from the Wamu mishap that we were still trying to fix. I was told to western union money and fill out financial worksheet and write hardship letter to prevent foreclosure. I sent everything in and later received a check for 6k. I called and asked what this was for and no one knew.

Later I was called and asked how much I could put down on a modify. I told rep about the 6k and he said hold on to it and we will first do a trial agreement. This will consist of 4 payments at a higher amount then current payment and after these are made on time we will then roll over balance into a modification. He said sign and date paperwork and send it back within 2 days fom receiving.

I got paperwork but not outlined as we discussed.instead it was 3 higher payments and the fourth was the outstanding balance in one lump sum. I contacted the same gentleman I spoke with and he said not to worry about the 4th payment as long as I contacted them before the last payment due date.

I did and was asked for my financial information. I was told I would be contacted in one week. That did not happen. I called and asked what was happening and was told that the system could not process information because there was a pending foreclosure so I would be sent a packet to fill out. I was also told that the foreclosure proceedings had been stopped.

I never received a packet. I did get a message to contact a representitive regarding my loan modification. When I returned her call one hour later I was unsuccessful. I tried several more times and finally was told my loan modification was denied for not adhering to trial agreement. They said I did not make the 4th payment or contact someone. When I told the girl I did and who I talked to and the day I called she placed me on hold. She came back and said it was because the amount due was to high to modify.

I was told that foreclosure proceedings had resumed and the schedule date of foreclosure. I was 3 months pregnant with a high risk pregnancy and filed chapter 13 to keep my house. Now its been over a year and I'm struggling more because of the chapter 13 and being a single mom. When Obama put his plan in place I felt relieved. Finally someone to help. Or maybe not.

I have now been given the run around with Wells Fargo concerning Obama's affortable home mortgage plan. My lawyer has sent a consent letter however they are saying it takes 30 to 45 days to show on my file. I have been dealing with this since march. Last friday I was told they still did not have it and that they must receive my worksheet, paystubs, hardship letter and lawyers consent letter at the same time. This was a first. Why I was not told this 2 months ago gets me. I know I qualify since my loan is through fannie mae, I just recently had a reduction in pay and my chapter 13 means the loan is deliquent. Wells Fargo strikes again! If anyone has had this happen and conquered the system please let me know.
