Suntrust Bank has committed mortgage fraud at its best. I am enclosing a letter that I sent to all directors and officers of Suntrust (15) certified return receipt requested. They all received them, but not ONE person from the bank showed any interest whatsoever. My home was being foreclosed and I spent two years trying to contact someone so that I could negotiate a repayment schedule. I filed bankruptcy and the house was sold at public auction. Dear Mr. Wells:

My name is Katherine Mxxxx and I am a former college professor, nationally recognized businesswoman and Mayor Pro Tem for ten years in Wilmington, North Carolina. I am also sixty-seven years old and had an experience with your bank that is unprecedented and beyond belief.

A few years ago, I obtained several home equity loans in an effort to maintain my once successful thirty - year old business. My business failed, and my loans went into default. As I contemplated bankruptcy, I signed a deed of trust in lieu of foreclosure to avoid involving the bank in the bankruptcy and moved-in with my daughter.

Subsequently, a very large debt procured by my corporation also went into default. After three court appearances, the Judge allowed the creditor to pierce the corporate vale and hold me personally liable. The creditor secured a lien on my home. I subsequently filed for Chapter 7 bankruptcy, the issue was adjudicated in a court of law, and the debt was discharged per judicial order of the bankruptcy court.

I spent almost a year attempting to contact someone at the bank who would discuss with me the possibility of refinancing my loan. That never happened. I was passed around from one department and individual to another. I finally spoke to a Lisa Young in the executive offices who informed me that I would need to apply again for the loan without any special consideration. On November 6 I received a notice from the law offices of Robert Lindsay that despite an order of the federal court, the home would be sold, subject to a lien that has been previously discharged, at public auction on December 1. I have made numerous attempts to contact Lisa Young for the name of the person in charge of my file in an effort to discern who would authorize such a blatant disregard of a court order. She has never returned my calls.

Finally, on November 17, I dedicated an entire day in an effort to speak with someone at the bank about my loans. This is the unbelievable scenario of that day.

A Patrice Maddox in the executive offices indicated that Lisa was busy and that she would return my call. She never did. I was then directed to the bankruptcy department where I spoke to a Lisa who located my file, refused to tell me who was handling it except to say that her name was Charlene and that she had no phone number for her. Lisa refused to provide me with her last name. I spoke with a Barbara and a Frances in the mortgage department. They refused to give me their last names. I then spoke with Derrick in recovery and went back to Troy in bankruptcy. I spoke with Tahisha and Adeja. My last contact was with Joel Olivas in real estate foreclosure. So far, no one at your bank has accepted the responsibility for referring my loan to Robert Lindsay for the auction. Mr. Lindsay refused to tell me his contact at SunTrust.

Finally, My Lindsay has informed me that he, against a judicial decree, will be paying the $28,000 to the creditor that was discharged in the bankruptcy court. He also erroneously asserts that I am not entitled to the homestead exemption allowed in the bankruptcy but can provide no legal basis for this statement. The last appraisal on my home two years ago was $374,000.00. I owe the bank $190,000.00. My loan numbers are: 08801120002300184,08801120002576320, and 08801120002849115.

It is clear that there are fraudulent activities being committed as no one will provide me with any information. The interest of the bank is not being protected as someone there is authorizing the payment of a debt discharged in bankruptcy, and I am unlawfully being denied my homestead exemption. I would like the opportunity to discuss the refinancing of my loan or at the very least, to receive my homestead exemption.

This situation, if not investigated and resolved lawfully, could create a legal quagmire for both of us. Please help me! I am enclosing a copy of all documents.
