Back in 1996, my husband and I got a consolidation loan from these people - when things were no better financially the following year, we rolled that loan over into a new one with more money.in 1998, we had no choice but to file bankruptcy under Chapter 7 - the loan from Beneficial was discharged and is a matter of public record.
Fast forward to October we are in the middle of refinancing our home... Everything is moving along smoothly until, guess who? Rears it's ugly head after all these years - BENEFICIAL! They are saying we can't refinance, why? Because we are now being told that those consolidation loans we took were actually a second mortgage! Beneficial has had a lien against our property all these years, and the only way to get it released we're told, is to pay $5,500.00!!
Mortgages cannot be discharged through bankruptcy, yet this loan was - because it WASN'T a mortgage! It even states on our credit report that it was paid off and closed by consumer. All these years, we never received a phone call, a letter, nothing - and now all of a sudden, we find out about this lien! Even the lawyer who handled the bankruptcy at the time is confused.
I refuse to pay Beneficial one red cent!!! Hopefully, the lender working with us to get this handled will succeed.
