Ridiculous overdraft fees mean we can't buy food or gas!

I checked my online account on the evening of Dec 2nd and had an available balance of (approx) $135 and was due an automated deposit going in overnight. I woke up and checked my balance at 2:30 am and the deposit had arrived as scheduled and I showed an available balance of $713 with NO HOLDS.

When I checked my balance again at approx 8 am on Dec 3rd I found that they had charged me three overdraft fees totaling $105 for three checks totaling $206 and an automatic insurance debit for $139.

At this point there is now $263 in my account and I have already mailed a couple of important payments out and am frantically trying to figure out if everything will clear due to the $105 charge. Now at the end of this day I have a check go through for $111, leaving a balance of $153. The next transaction is $9.. Should be OK and then $202, which should have cleared if not for the overdraft fees and they charge me $70. And the $202 is clearly shown coming in AFTER the $9 charge.

So now when my balance should be like this $713 - $667 = $46, I am negative $118 and I know that there is a $10 check out there. I sell something to get a deposit to the bank and take $200 cash to the bank and hand it to a teller asking for it to be deposited immediately. I come home and my online account shows an available balance of $81. Thank god... My $10 check will clear and my automatic phone bill of $33 will clear in a couple of days. I wake up this morning and I have a balance of $1!!! They went back and posted the $10 check before the deposit and charged me $70!!!

Now my total transactions for the week look like this Positive $913 - 687.79 which means that I should still have a positive balance of $245 but I now have $1 and the phone bill is yet to come in.

And every one of my deposits came in prior to the debits that they are posting overdrafts for. I am not eating and Wachovia is getting bailed out with my tax money.

I am looking for an attorney that will handle this. This bank (and others I am sure) is changing the time of our deposits so that they can do this. I had an overdraft a couple of months ago because they changed the time of a charge at a store to move it up before the afternoon posting time. I know this because I had the receipt showing the transaction time and when I went to the bank to talk to someone about it they claimed that their records showed that the charge was made at somethime like 1:30pm when I knew that I was not at the store until about 3:30 and I was able to produce a receipt with the actual transaction time on it. I belive that they are doing this routinely and from now on I am going to print my online statements to prove it.

Keep your receipts... I hope I still have the on I just mentioned but I never thought this would become such a big deal.
