Fairbanks bought our mortgage which is a second mortgage a couple of years ago from U.S. Bank. We went through bankruptcy shortly thereafter. They stopped sending us bills, insisting we had to give them our checking account number so they could get the money directly because they could not send us bills even after we told them to. We wouldn't do that as our other mortgage company sent us bills once we informed them that we wanted them to do so.
Fairbanks then sent a letter supposedly from a lawyer because we were behind. We then went through a forebearance agreement in which we kept up with current payments plus paid back what we owed as well as the legal fees. We paid all of this for the 12 months requested without missing a payment ever.
Since the forebearance, they still wouldn't send us a bill for quite a few months. When they did finally start sending us bills, they insisted we had missed a payment and were starting to rack up a lot of late fees. We will not pay this as we have never missed a payment since the forebearance agreement began.
When we called, they said we missed a certain month; I checked with our bank, and the check for that month had cleared. I called them again and told them the check had cleared. They then proceeded to keep changing what month we supposedly missed and transferring us to another person, then another person, then another person. They finally just transferred us to somewhere where we were told to leave a voice mail message.
I have since made copies of my checks written to them during this time period and had our bank send us a printout of checks made to them with the dates they cleared. Not one payment is missing, and we have the proof. I've told them this, but they persist in our missing a payment and owing them more and more late charges every month.
We don't know where to turn with this anymore. You can't talk to them because their favorite thing to do is to keep transferring you all over the place.
