White out on mortgage, changed vin on documents, lied, overcharged $27K on a home

This is a follow-up to Mr Mike Kergosion about the buyers remorse, etc... Fisrt of all, I called YOU, and YOU hung up on me. I also emailed YOU and you forwarded the emails to S Mayher. The "deal" was "shady. I signed a contract to buy a River Birch home that was $69K, but on sale for $59K. I got approved through your mortgage company, was told the pymnts and interest would be lower than they "came back with", and I told your dealersalesman in Cabot, AR"NO".

This guy [I won't name him for legal reasons] called Sherry [supposedly], and told her I could not afford the RiverBirch and needed something less expensive. I was switched in and out of @5 different homes, and shown the Fleetwood that was delivered. The Fleetwood retailed for $54K, and I was told by the salesman I could have it for $49K [I have all of this on tape]. The salesman told me the pymnts would be what I wanted them to be, per a supposed conversation he had with your loan officer.

The home was advertised with appliances - which were removed before I got it. I asked the salesman to make out a new contract, GFE, etc so I would have it-as that is the legal thing to do. The salesman told me I would have it the next day - I didn't get it, I was ruched to a closing agency that THEY picked, and was told the contract would be with the closing docs - it wasn't. When the closer came in the room, the sales guy left.

I noticed CLEARLY, that the mortgage was made out using the EXACT figures quoted to me on the more expensive RiverBirch, AND the mortgage was made on a 24x48 RiverBirch, not a 28x80 that I signed for in the beginning. The VIN, and description were to a 24x48 RiverBirch, and the price was from the 28x80 River Birch. On the first page, it said that a check was cut to Fleetwood for $26K to pay off that house - the one I got, never signed a sales contract, no title, vin not on my mortgage, appliances removed [ring a bell? }.

I told the closer the mortgage was NOT right, and told her I wouldnt sign until it was redone. She told me I had to, that she had called YOUR bank and spoke with the loan officer [above] and said I had to sign it, or I would be in a breach, defaulted on, and sued, and get no home, BUT EVERYTHING supposedly was to be fixed IF I signed. I kept saying, no it isn't right. The closer got a bottle of white out and started whiting out VINS, the description, alot - which I am told is ILLEGAL. BUT, I am disabled, have never bought a home, asked for my attorny - and was pressured to sign or my life would basically be ruined - no home, no credit, ruined-AS IT IS TODAY!!!

I never have gotten a title in 3 years. WHY? The mortgage states I own 2 different homes with conflicting vins, and neither are the right ones. I complained to your bank, and the dealer. The home was inspected and was deemed defective from the factory - Fleetwood cancelled my warranty. Your dealer never brought my driveway - they dumped concrete in my yard, and stopped pymnt on the check for the runners and the concrete.

They never brought my appliances, nor the stairs - imagine that. Then, they all quit the dealership. I contacted the owner, and he told me he found the sales contract i signed on the 2005 28X80 RiverBirch, and that was all I signed, and I actually owned that house that was still on his lot in July of the next year - he cursed me and told me to sue him. I spent thousands trying, but he and the salesguy ran to different towns. He is now out of business - I hope - and think.

Your bank sold my mortgage to another bank, your bank also never credited me for 4 pymnts I made to you. The bank you sold it to stopped accepting pymnts b/c I couldn't surrender titles to the 2 houses it looks like I bought on my mortgage. I have your loan officer telling me on my answering machine before the mortgage was sold that "all of this would be fixed and corrected" her words. It never happened.

So, the bank that bought my mortgage foreclosed on my land [because they couldn't apply pymnts correctly] and "a certain mobile home on the land". Mr Kergosian, I put my hard earned savings down on a home I NEVER got, and I got a home that was not only defective, had appliances removed, etc, but that I cannot ever own due to the greed and corruption of people that you and your bank had a responsibility to keep ties on.

EVERY attorney, including the atty general of this state tells me I have a major case - but now, I have not got the thousands of dollars to pull everyone in court. I went on that lot to buy a home - not for an investment, or to get rich, but to have a home, a place to live, PAY FOR, and pass to my child one day. That is so far ruined. Alot of people ask, why don't I walk away from the home? Because someone will either finally listen, or read this - and take everyone to court - or to jail.

I am not the suing type, but I am not the type to be screwed over and take it, I am a fighter, and I am a Christian man, and have a Christian family. It is down to the wire, but I will tell you this - IF i cannot get this straight in a court, or with a settlement, all I can say is Kharma - well, you know what they say about it. The country is in the mess it is today because of shady and greedy and dishonest business people. I am not judging, but this could have been avoided had you, and your dealer, and your retailer worked for the good of your customers. That is all I have to say to you, sir.
