Mr Kergosian,
I am writing you to tell you that I did in fact email you multiple times about the problems with my mortgage through Worldwide. Let me say first, Ms Sherri Earnest Mayher was very friendly through the process. I did email you, after she gave me your email adress.in a nutshell, this is what happened. I went to the dealer in Cabot, AR and got approved on a 28X80 River Birch home for $70K, and a parcel of land for $10K. The salesman, DB, told me he would run it by Sherri. Two weeks later, we got approved and I put my down payment on that house. When we got approved, the salesman [DB] at the dealer said the payments were going to be around $725 to $850 with a FIXED rate or 6.5%. The FIXED rate, in my opinion was great, as that is what I wanted. However, beind on a fixed income, I could not afford that large of a home and that large of a payment. I did like the RiverBirch brand. DB, showed me a smaller RiverBirch that retailed for $49,999 and told me I could go find some land to put the homw on not to exceed $10,000 in price. DB [salesguy] said he went in and called Sherri and "ran it by her" and told me she said the rate would be 6.5% fixed and $525 monthly. AGAIN, I never signed papers at that time to buy said home, but I told him I would take it at that price and at what he quoted me. I do have this on video also. He told me to go look for some land, I did, put in an offer, I did, and bring it to him at Affordable Homes to get it to Sherri. I did all of this, and november of 05' his appraiser asked me where this land was to appraise, I showed it to him and left. After thanksgiving, DB, and AKM [who said he owned the dealership but didn't] told me we couldn't have the smaller River Birch because the land didn't appraise "good". I told both of them I would look elsewhere, DB, and AKM told me they had on the lot a 2006 28X60 Fleetwood for $54,999 but would sell it to us at $49,999 if we liked it. When we looked at it, the washer, dryer, and freezer had been removed, and the dealer said they hadn't been delivered but we would get them. They also said we would get 2 sets of steps [got 1], a driveway, never got it either. DB, and AKM took us to their closer in Little Rock, I wanted my atty their, DB told me he was my attorney in this matter [which was false]. I noticed on the closing papers, the house that was on the mortgage was the 28X44 River Borch[as they spelled it] with the exact figures they [DB and AKM] had faxed to Worldwide on the only credit app or GFE we signed which happened to be on the 28X80 RiverBirch home for $70K plus the land of $10K. The VIN to the 28X44 RiverBirch was all in the mortgage, as were desprepencies in how much money we made, our occupation, etc. I told the closer that I wanted my own attorney there. She advised me she would "fix" the mistakes. The closer told me she calld Sherri at Worldwide and Sherri told the closer to use "white out" to change the VIN, and some dates, but nothing else. DB, and AKM along with the dealer had switched us out of several homes in my opinion b/c they knew we had to get out of our rental because it had been sold and we had to vacate on 12/31/05. I insisted to the closer this had to be illegal, a mistake, let me call my attorney, or Sherri at Worldwide - closer told me DB, and Sherri would "fix it" but I needed to hurry up and sign. My wife and I were terrified, we had to either sign and hope this would get fixed, of leave and lose the disability money we had saved for our downpayment and be homeless. After this was said and done, the house started leaking, buckling and growing mold. I have statements to the effect it is a defect. Fleetwood would not fix anything but put in a few bricks under the home. We never got our appliances that we are paying for, nor the driveway, nor a title to surrender. When USBank got ahold of this mortgage, I got a call from ther tax dept wanting to know why I had not surrendured titels on the 2 homes I had bought, the RiverBorch 28X44, or the Fleetwood [that had been "whited in with a partial VIN] I told USBank I never recieved any title to surrender and I only bought 1 home, the Fleetwood. USBank said they had flagged my acct as "suspicious" and were supposed to contact Wroldwide to get a copy of the contract we signed to by the Fleetwood-which we didn't sign, but knew we were getting it a a different price, and a fixed APR. Then USBank through us into foreclosure on the land and "partial interest in the structure standing at the adress". The only way I could get USBank to take any payment was to file a chapter 13. THEN, when we got caught up on legal fees and the 2 months they wouldn't take pyments, I contacted them and sked if we got out of chapter 13 could we go ahead and make our regular monthly pyments, and them release the $3000 they had in escrow they have been holding to put on principle, they said yes, and then sent us yet another NOD, and threaten to foreclose due to the titling issues. I even tool the mortgage to several lawyers who said the same thing, the "F" word, and it is too complicated, we should walk away, we should forget it, and I took it to the state who ran the VIN on the home that is here, and they told me there is no lien on the house because there was never a title issued, nor a lien holder for the VIN on this house. Mr K, I have written you several, at least 18 and you have told me you can't do anything about it, and you referred me back to Sherri Ernest. I am not completely pointing my finger at you, there were other people involved, some of whom need to be jailed, as we have been put through a nightmare. We just wanted a home, to pay for, not a mansion. Sherri asked about refinancing, I can't refi a defective house, it isn't worth over $45K. I found a great house here in town for only $35K, 1500 square foot 3br, 3bath on almost an acre, that would be a dream to me to get out of this nightmare. I haven't hired an attorney, I have asked for help, I have emailed you, and written you. I would love to show you pics of the house, the video, the papertrail, but you are in TX. I honestly think, some of these people who "fly by night" don't care, they make thousands off people like us who need and can pay for a house, and mess us up for life. That is the short story.
