My husband deposited $3300.00 to my account on one day, believing he had withdrawn funds from his account and deposited cash into my account.in fact, IBC had processed the deposit to his account as a "split deposit" between both of our accounts. The problem with this is that he is not an owner or even a signer on my account and, according to a TX legal expert, IBC had no authority to do it this way.
When his client's check was returned NSF, they charged the entire deposit back to my account. The chargeback was more than twice the amount of the initial deposit. They first said they would reverse the chargeback and place it against his account. But then, a manager said that with split deposits they always return to the account with the most available funds.
That would have been fine, if in fact there had been a split deposit among his accounts. He had no authority on my account. No attention was given to the fact that they didn't have the authority to deposit in the manner to begin with and the check was payable to him, not me.
Although the branch manager tried to be helpful, she was unable to do so because of decisions by higher management. And all of this took place because the deposit transaction wasn't processed correctly by an IBC employee initially.
Hundreds of dollars in fees later, the situation has been resolved because the client's bank fixed their end of it. Ironically, I was told although it was returned against my account, I had no claim on the deposit and couldn't deal with the payor or their bank because it wasn't payable to me. It's interesting that they felt free to take it out of my account.
I'll definitely be changing banks as soon as the dust settles.
