Illegally foreclosed while still taking payments

Homecomings Financial/gmac should be put out of business! We are the latest, and possibly one of the earliest victims, and did not even know it until we recently tried to list our home for sale. The realtor said would be hard to sell it, as Homecoming has clouded the title, by saying they foreclosed on our property, July 03.

It all started when they raised our payment by almost $800, due to escrow shortage. We expected the taxes to go up about $400 that year, due to value of property going up with our dream home being built and getting rid of a double wide, however, not that much. We struggled, but made those payments for awhile. Then we got in a little trouble, fell behind 2 months, and they quit accepting one payment.

Last year in October, we thought we had it refinaced through another Mortgage co. Whom deserves a complaint themselves, Merchants, Brian McCauley, they messed around for 3 months, telling us we were pre-approved, would have this all wrapped up, Homecomings paid off, some of our bills, and extra for Christmas, but then dropped us like a bad habit, due to Homecomings reporting us 3 months behind. We urged him to hurry, his excuse, the appraiser he sent messing around too long. So when they dropped us, we at 3 months behind, submitted reinstatement papers to Homecomings. We were denied.

We continued to try and get someone to refinance, with no cash out, but by now, nobody would touch us. Our credit being screwed up by all this, and so far behind. Homecomings still refusing to accept one payment. They sent us reinstatement papers again. They again denied us. They by this time, adding $55 plus a day interest, and $92 plus in late payment every month but not accepting a payment. Then they added attys. Fees, and threatening foreclosure. Mind you, not any normal threat, telling my wife on the phone, that if we didn't pay all past due, every month for several months, that the first Tuesday of the next month, our home would be sold on courthouse steps. This causing her to go crazy on me, and after 21yrs. Of marriage, at this point, has come very close to causing us to divorce. And, her elderly parents (72yrs. Old), and poor of health, have been living with us for 12 yrs. Now, and rely on us to keep this roof over their heads.

It gets worse.in June, after already submitting reinstatement papers twice, and hundreds of hours on hold on the phone, we resubmit the same reinstatement papers for the third time. This time they accept it, as long as we give them a downpayment of $5000 before the 1st of July. We sent it June 22nd, they accepted it (cashiers check only). Saying they would stop the foreclosure sale scheduled for July 03. And, this would be a trial period, with our payment that was $1900 at first, then $2700 after going up because escrow shortage, and now our new payment would be $3000, the extra going towards what we were behind on. Which we have made all the payments. Then promising us full reinstatement, the balance that they have now trumped up over $40,000 extra to go on end of note. Even though we have made all payments ($15,000), no reinstatement papers.

We decided that we would have to sell and move on, as this just getting way too high to handle at this point, and called a good friend for referral to a realtor. We spoke with him, and were going to list the property for sale. But, he called back saying would not be a good idea to list right now, as our home's title is now clouded by Homecomings, who is reporting, to all agencies, that they actually foreclosed, and put our home up for sale back in July, even though promising not to. And, now, telling us we need to hire an attorney, and sue Homecomings, before we can even have a chance of selling, and we don't even want to. This was our dream home, built it ourselves, could've just kept the double wide. Now in danger of losing it. Somebody please, please, help us! I have contacted an atty. Who says, they may very well have illegally foreclosed, but he wants money up front to take our case, and we just don't have it. It has been all we can do to make these payments. Oh my god what a joke this Homecomings is. Please, Please, somebody help us put them out of business, before they tear other people's lives apart. They have still been adding over $1500 a month to our balance as "Per Diem", all this time we have been making payments. The whole thing is outrageous. Somebody please help, or give us advice to who can. Thanks
