I took a payday loan with Payday-loan-yes.com and paid a few renewal fees and then filed bankruptcy. I've provided the bankruptcy information repeatedly to these people and they now have turned it over to an attorney and are saying I commited fraud. However, during the time since I received the loan and the bankruptcy followed not too long after that and then I filed for divorce.
The banking account was a joint account in which my husband and I shared but that he was the primary person on the account. When the divorce was filed he closed that account. I was told that everything was fine up until today when I received a call from their legal people stating I had until 1:00 today to get $850.00 to them. I don't have that kind of money and when I said I'd faxed bankruptcy information to "TIM" at payday-loan-yes three times and they stated they were told that they have had no contact from me.
I have emails as well that I sent to TIM stating that bankruptcy was filed and gave him case numbers, etc... So that if he wanted to file a claim against my Ch. 13 he could and they could recoup through the bankruptcy.in my records from the bankruptcy they did not file a claim against the bankruptcy. I need advice from anyone who would know whether I really "owe" this to them even with a bankruptcy when they failed to file claim. Thanks!
