We filed Chapter 13 bankruptcy in October. We went to our lawyer and gave him all of our information, went to court to finalize it and then May we got a report from out trustee that had people who filed a claim since March and to our surprise Merrick Bank filed a claim against us for $1,714.78 and we have never had or used this card at all.
So please watch your credit report plus make sure you look over your bankruptcy papers carefully if you have to file because they will file a claim with the court and you will have to pay them because they know that it costs too much for you to do anything against them when you are in bankruptcy.
If anyone knows anything I can do to get this bank for the illegally filling a claim with the bankruptcy courts please let me through the rebuttal key.
