Fraudulent charges, ruined my credit, rejected payments, list goes on, on

Anyone getting a class action suit against this company, I am very much interested in joining! We've had nothing but trouble out of this company since they bought our account in two months after our house was financed.

The first year of our mortgage, our payments were never late, if I was going to be a little late I would call and notify them, even make arrangements for a check by phone on a specific date, until they processed a payment by phone before the actual date that we agreed upon, their check cleared, but it made my utility checks bounce, and several others, I had over $300 just in charges and after agueing with them for 3 months they finally sent me a check for $185 to cover my charges, but then they took it out of my escrow?

The second year the insurance coverage that we purchased was cancelled due to the company no longer servicing homeowners policies in AL where we live, they sent Homecomings a letter indicating the cancellation and sent the refund check to Homecomings. When the refund finally showed up in our escrow account and I called them about it, they didn't have any ideal as to what was going on, they allowed our mortgage to go a whole year without insurance before they notified us (it had actually cancelled the year before).

We were having some difficult times beginning in November, due to my husband having to take personal time off from work and me finding out I was pregnant w/my 3rd child. We fell behind one payment before Christmas, and I immediatly asked about the overage in our escrow account, they refused to allow us to use that.

Carrying over into in Jan, I pd Dec pmt, Feb, I pd Jan pmt, and I called and notified them that in March I would be making two payments to bring my account current prior to my taking maternity leave in April, when I sent my feb payment at the beginning of March, they didn't process it, they held it for about three weeks, until I was about to send my March payment.

Then I received a call telling me that I had to send them $900 plus dollars to bring the account current before the 31st or it was going to foreclosure, I explained to them that this was impossible, I was preparing to go on maternity leave and I wasn't $900 past due, they told me not to worry about it they could send me to an account manager, set up a repayment plan, and all would be well. Not hardly. I was told this would be much better than having a bankruptsy or foreclosure on my account, this would stop my account from going into foreclosure, and they would even give me a month in between to come up with the money that I would need to pay down (they told me that if I did send any payments before the scheduled date for my down payment on the repayment plan, they would refuse the payments and proceed with the foreclosure), etc...

I went into the hospital to deliver my daughter 6 weeks early do to complications, when we finally got home, there was my check that they returned to me, stating they couldn't accept it because my account had been turned over to foreclosure, a few days later, I received a letter from an attorney telling me what day my house would sell, needless to say, I managed to scrape together enough money and my husband was back to work full time, we went on the repayment plan.

I asked them several times prior to my account getting behind, prior to them sending my account to foreclosure, about the overage in my escrow account, why I couldn't use that money to bring my account current (I had almost enough money to pay 3 payments, about $100 short) they said that was against there policy???

So finally after being on this plan for almost a year, in Feb I spoke with someone at Homecomings that told me there policy had changed and I had enough in my escrow account to finish paying off my repayment plan. This has been going on non-stop with this company and my account, I started my 3rd work out plan last year because we were going to refinance with another company, Homecomings refused to work with them and wouldn't give them the payoff, when my credit report was first pulled by me, my mortgage was only listed as having several late payments, when we went back to pull it for the refinance, homecomings had changed the reporting to foreclosure,

So needless to say, we were once again facing a repayment plan (2nd) after being on the plan for a few months, I called to tell them at the end of Aug, that my husbands work hours were drastically reduced, and he was looking for other employment, knowing that the next pmt due was Sept 2, the CSR informed me that she didn't see a problem with that because my account was current through Aug, and as long as I made my regular mortgage pmt, they couldn't foreclose on late charges,

So, I continued to make my reg. Pmt, for 3 months via western union, when I made my pmt in Dec, they rejected it, sending me a letter dated for 1/5/07, I received it on 1/12/07, called them immediatly, once again they couldn't accept the payment because the account had already been sent to their foreclosure attorneys,

I received a letter from their attorney after that, dated for 1/11/07. Went on my (3rd) repayment plan to prevent foreclosure, my husband was layed off his job due to the business closing recently, I called at the end of May to let them know I didn't have the June pmt, when I was finally able to talk to an account manager on a thursday, after I had already missed my payment, he informed my that he doesn't make return calls on Friday, and for me not to worry about it, they would foreclose for at least 30 days, I would have time to enter into another workout plan!

I've made several request in the past month, and year, for copies of my (forced) insurance policy, my account transition history, monthly payment stubs that they don't send while I'm on a repayment plan, and details of how my payments are being applied on my repayment plan, I've yet to receive any of it, I even called GMAC corp to file a formal complaint, 3 weeks ago and still no communication with anyone! (I filed a complaint with my states attorney generals office, but they're telling me that can take 4 to 6 weeks).

Can anyone please help me, i'm at the end of my rope, i work overtime every week trying to keep my head above water, i can no longer keep my blood pressure under control with just diet and exercise, my stress level is through the roof, and it's all taking a toll on my marriage of 13 1/2 years. If anyone is filing a classaction suit please let me know!!!
